It's 1AM and I haven't been paid

  • It's 9AM and I still haven't got paid. Neither has one of my colleagues. Do I have any rights?

    I get paid in arrears - so I work a month and then get paid the last day of the month. I only resigned 3 days ago so I work until the 24th of November

    And if it still hasn't been paid, there is the likely asnwer. You resigned three days ago. Which isn't enough time for many employers to complete a final salary run, which may involve adjustments to check for holiday owed by either side or any other deductions due. Three days also isn't any kind of notice period - the minimum is one week! So you aren't in any position to claim a breach of contract by the employer, since they haven't refused to pay you, and any delay is down to your lack of notice!
  • i would ring your bank and warn them they may be able to see the payment coming in in the next 24 hours ask them if they can mark the important s/o eg rent paid so it doesnt get returned. i would also ring your employers payroll and find out whats happening

    Surely it's not the answer at all, the OP doesn't leave until 24th November so this won't be the last salary run, that will be the one at the end of November, when any adjustments will take place.

    As one of the OP's colleague's also hasn't been paid it sounds more likely that they have messed up either the whole payroll run or payments to a particular bank have gone astray. Contacting the bank will establish whether anything is coming, contacting the employer will find out whether it's been sent at all. Either way, keep a note of any charges resulting from non-payment and take that up with your employer, even if it's the bank's fault it's the employer's responsibility to pay you as per the contract, and they should repay any charges incurred if that has failed.

    The OP hadn't posted the information about their colleague when I posted. What they had said was that they got paid at the end of the month for the month worked and had handed in their notice only three days ago. So this would have been the last full run and the only one that deductions could have been made from since, at most, the November salary consists of two days pay (assuming they are working toay and tomorrow, which they haven't said they are - because if they are in work they could ask the employer why they haven't been paid when they get there).

    OP said they handed their notice in 3 days ago, so a months notice, but would be working until 24th November so it wouldn't be the last pay run. I assume they would be paid their final payment end of November

    this ^^^

    check with your bank to see if there are any payments coming into the account. if there aren't, contact payroll and ask them what's going on.

    The OP is not leaving till the end of November so I don't think they are holding on to paying them till then.
