    Why though do you think that your wife will need you to be with her though? As others have said this isn't usually needed unless there is something else wrong.

  • Just a thought but is your wife disabled? If so, have a look at associative discrimination.

    If not, as others have said, a hysterectomy would not usually require someone to be cared for 24 hours a day. Make sure the hospital know she will be alone 9 through 5 before they discharge her to be sure they assess her correctly.

    I quite understand that and it's entirely up to you how much information you give here. However from what you've previously said we had no reason to think that your wife was going to need any more help than any other woman following a hysterectomy.

    In that instance, definitely check out associativ discrimination. If your wife is disabled under the definition in the Equality Act 2010, you are her carer and your employer must take this into consideration in allowing you reasonable time off to carry out your caring duties.

    The law relating to associative discrimination is not a clear cut as that.

    A carer may have a right to time off to care for a disabled dependent in some circumstances, but if you are going to go down that route and potentially put your job at risk, you should seek specialist advice.

    Unfortunately the government has withdrawn funding for the EHRC advice helpline. There is now a new Equality Advisory Service which provides information, but does not offer legal advice or provide representation. Nevertheless, they may be able to explain your rights and your employer's obligations in your specific situation

    Could one of your wife's family come to stay for a week? I understand they live some way away, but maybe they could stay over, or stay in a B&B close by?

    They wouldn't necessarily need to stay the whole time - maybe she has a couple of friends who could do a day each?
