I'm not sure if this is really the place to be asking this, but I have no idea where else to look, so it has to be worth a try!
A few weeks ago my car was hit from behind in an accident that was 100% not my fault. To cut a long story short, the third party's insurance company have decided my car is not "cost effective" to repair and have offered me the "pre-crash value" instead, which obviously is nowhere near enough to get my car back on the road.
So, is their a law that says they can do this? I really can't believe that an insurance company can decide whether or not I should have my car repaired! And is it possible for me to take them/the third party driver to court to try to get more money from them?
If I can, does anyone know how!?

I think they can right a car off, and just give you the price of what the car is worth if they belive it is beyond econmical repair. I dont think you have to accept the offer if to low a bit of haggling maybe required.Non Gradus Anus Rodentum!0

sorryt to say but yes they can do this - they have just done it to me (third party fault). There is nothing you can do about it.0

They will will write off the car as bobmacuk says,if the repair is too expensive to prove economical.
The main problem is that insurance companies usually have to pay top whack labour wise to repair a car,imagine if you had a year old Ferrari,would you want it repaired at kevin websters or the local Ferrari dealer?That's the problem really,just don't accept the first offer they make you ,good luck.There are two sides to every story.

I'm in the same boat mate.
My car is an "R" reg and I want to keep it. I drive it every day with a big dent in the side.
It's been written off because of the price of genuine parts.
I argued that it would cost me too much to get a replacement car.
I phoned the appointed garage who quoted for Admiral and asked them to re-quote me for the same repairs minus genuine parts. It should be at least 30% below the original quote.
I have an insurance bloke coming to examine my car on Monday at which point he will offer me some cash to keep the car or write it off if we can't agree. What else is Admiral going to do with it?
If he offers me over and above the new private quote from the garage then I'll do the deal. I might even get my excess payment covered in the deal? Who knows. I'll post back on Monday.0 -

Obviously I understand the concept behind it - "uneconomical" is a word they like to throw into every second sentence. What I can't get to grips with is the fact that the third party's insurance are the ones who get it easy. Surely they should be obliged to repair my car regardless of the cost?? Or are car insurers different? If I claim my home insurance, they don't haggle over how much something is or isn't worth, they just replace or pay out.
Does anyone know how to fight this through the courts without involving all the hassles of lawyers etc? Something along the lines of a small claim that I can do on my own?

Firstly, I'd look for a car that is similar to yours and check the value. If this is more than is offered, state this is how much you would at least require before considering. Once you have this, ask for how much they would accept for you to buy your old car back. It may be possible to buy it back and pay for the repairs yourself, and being in pocket at the end of it all.matched betting: £879.63

If they write it off they'll auction it to staff. Whoever buys it (cheap) can then get the repairs done and either keep or sell it.
