Statutory Periodic Tenancy/Agreement - not legal?

    Hi all,

I hope this hasn't been asked elsewhere, I have had a search. We've just been informed by our LA that we need to sign a new TA. This is months after our old one lapsed, but apparently they're doing some 'catching up'.

I was surprised to be hit with a £75 cost for this, as I've not had to pay a charge before. I did some googling and found a very helpful thread on here about TA's lapsing into Statutory Periodic Tenancies/Agreements, and that essentially being all you need (unless you want the cushion of a set period when the LL can't turf you out, which is only 4 months on our 'new' TA anyway)

I called our LA (Winkworth) and asked about this, only to be told that legally they can't have us on a SPT and that we need to pay the charge. This sounds like horse manure to me - and it wouldn't be the first time they've lied/ommitted to tell us something.

Has anyone got any experience of this/any legal back up that they're talking rubbish?

    Many thanks!
    Peterkin

What a surprise. Another half-wit lying letting agent. It's total rubbish (LOL). You have no obligation to sign another AST.

Often agents are rather less quick to mislead or bend the truth in print.

Not the ones I deal with at the moment. Yes, they're that stupid. In writing and also in writing that they'll conduct viewing without my permission and, in fact, even when I insist upon a different time.

How helpful, supplying all the evidence you need in the event of a dispute/ court case! :rotfl:

Yes. Even after dealing with theses morons for over a year, I was still surprised they could be that stupid. I contacted the landlord directly in the end, and the LA had the nerve to sternly tell me to never do that again. :rotfl:
  • Well all, thanks so much for your advice and encouragement. We called the landlord who knew NOTHING of the new TA and has told us if we're happy with the SPT then so is he. I've emailed them to tell them this, and the LL is going to deal with the rest for us.

So glad my suspicious nature kicked in and I didn't just write out a cheque for £75!

Beware Winkworth. I don't know whether the agent I spoke to was malicious or just dumb, but either way, it's no way to run a business.
