EH should be informally mediating by now, are they? Don't worry about a gap in your noise diary, just note you were away from home.

  • In the short term, could you and your other half take it in turns to wear earplugs and get some rest so there's still one of you able to hear the baby? (Even better: you've just given birth, so you wear the earplugs and get some sleep, and he wakes you up when baby needs you!)

having a baby is a partnership, both need to be looking after the baby, saying the man should because the women gave birth is sexist, apart from that, the man is probably working too.

Local authority EH are responsible for noise nuisance like this. You could also argue that this is anti social behaviour as well which makes the local police force equally responsible.

As has been said already the noise diaries can take a while to make any impact that is because the council eventually have to take the issue to court and need evidence to do so. Therefore it takes time to build a case.

At this stage you are complaining about your neighbour to the council. If you are unhappy with the council service you are also able to complain about the council through the council's own complaint procedure. So if you feel they are not doing what they should be then raise a complaint by writing to the chief executive of the council making a formal complaint about their service.

Following completion of the council's complaint procedure, if you are still unhappy and believe the council have done wrong and have not rectified it you can complain to the Local Government Ombudsman.

Stick with the noise diaries. If the council can determine there is a statutory nuisance then they can issue an abatement notice and even take away the offending equipment such as the stereo. It may take time but hold on in there and you should get results.

Good luck, I don't envy you!

Oh how i would have loved to of had you as my neighbour when my tenant was creating merry hell in my property. the only time we knew was when we had a letter from EH informing that they were going to take us to court for the behaviour of our tenant, it was not until i informed EH that the property was supposed to be managed by a letting agent and they had not informed us of anything, that EH stopped threating me.

hence the tenant was given notice, using the correct procedure by the managening agent.

oh and we have just issued a warrant of execution for the money that the tenant owes us for the state she left my property in, £12,000. worth of repairs that really would not had been needed if the neighbours had bothered to find me - i lived less than a mile away and they know me! so someone saying the landlord will do a lot at all is a lot mistaken !

Good luck, hope you get this sorted sooner rather than later.
