For Existing AMEX cardholders - £5 cashback for spending £5

I've just heard that American Express are offering a promotion where you can get £5 credited back to your card once you register your card and spend £5 or more at participating small shops over the month of November.

I can't see any catch in this offer, but I guess the idea is that people will end up spending more than £5? I suppose there is also a risk of the cashback transaction not going through.

Just want to personally add that I hope no-one goes overboard / too greedy with this offer, because we all know that it usually spoils things for everyone in the long run (either through fewer or less generous offers being available in the future or for the campaign to be pulled or the T&Cs changed in the middle of the campaign).

To be eligible for the £5 statement credit, you must register your American Express Card here and use that Card to make purchases of £5 or more at participating "Shop Small" merchant locations between November 1 and November 30, 2012. Limit one statement credit per Card at each "Shop Small" participating merchant location. This promotion is open to residents of the United Kingdom who are existing American Express Cardmembers and whose Card is issued in the United Kingdom. American Express Corporate Cards and Prepaid Cards are not eligible. Statement credits are generally issued within 3-5 business days after your qualifying purchase, but may take up to 2 billing periods to post to your account. If your card is lost or stolen, you will need to re-register your card here in order to participate on the campaign. Excludes online transactions.

Please note, if you have already received a credit by spending at a select merchant location through the standard Shop Small offer, you will not be eligible for a further credit by spending at that same merchant location through the Foursquare Shop Small offer. Please carefully read the following terms and conditions (the "Agreement") before registering for the programme offer(s) (the "Programme Offer") provided on this registration page (the "Registration Page"). By registering for the Programme Offer, you are agreeing to be bound by this Agreement with American Express Services Europe Limited ("AXP", "we" or "us").

Any additional terms and conditions between you and the merchant which apply to Programme Offer(s) ("Offer Terms") will be displayed in conjunction with each Programme Offer. Programme Offers will be provided only to Eligible Cardmembers (as defined below) who have registered for the Programme Offer(s) and agreed to be bound by this Agreement and the Offer Terms.

A. General

The Programme Offer is provided by AXP through a computer having access to the Internet ("Computer").

B. Eligibility and Registration
Eligibility. To redeem the Programme Offer set forth on this Registration Page, you must meet the following eligibility requirements:

· You must be 18 years of age or older and be a valid holder of an Eligible Card registered with the Programme Offer.

· An "Eligible Card" is a valid American Express Platinum Cashback Credit Card, Platinum Charge Card, Preferred Rewards Gold Card or Green Card card issued in the UK by American Express Services Europe Limited. Prepaid cards, gift cards, small business and corporate cards are not eligible. You must meet any additional eligibility requirements contained in the Offer Terms.

· Cards relating to accounts which have been open for less than 100 days are not eligible. The account under which the Eligible Card is issued must be active and not in default or (in our reasonable opinion) at risk of default.

A Cardmember that satisfies these requirements is referred to as an "Eligible Cardmember."

a. Registration. Eligible Cardmembers must register an Eligible Card for the Programme Offer on this Registration Page. You may register only one Eligible Card for the Programme Offer. The Eligible Card that you register for the Programme Offer is referred to as the "Registered Card". If you have any problems with your registration, please contact customer services using the number on the back of your Card before making any Eligible Transaction(s) (as defined below).

C. Programme Offer Redemption

To redeem the Programme Offer, you must comply with all of this Agreement and the Offer Terms, which includes, but is not limited to, completing the eligible transaction(s) (the "Eligible Transaction").

Your Eligible Transaction(s) must be charged in full to the Registered Card. Transactions made on another unregistered card account or a supplementary card with a different card or account number are not eligible.

The Programme Offer is only valid during the campaign period specified in the Offer Terms (the "Campaign Period").

Your reward from the Programme Offer will be as described in the Offer Terms.

It may take up to 12 weeks from the end of the Campaign Period for the reward to be posted to the Registered Card account. The reward is not owed to you until it has been processed and credited to your Registered Card account.

D. Additional Programme Offer Terms

The following terms and conditions apply to every Programme Offer, unless otherwise specifed in the Offer Terms:

1. Programme Offer is subject to availability;

2. Programme Offer can only be redeemed by following the redemption instructions included with the Programme Offer;

3. Programme Offer cannot be combined with other promotions or offers;

4. Programme Offer is not valid for purchases made prior to registration.

Other restrictions may apply, as set out in the Offer Terms.

E. Availability/Interruption.

You acknowledge and agree that we are not responsible for performance degradation, service interruption, unavailability, suspension or delays due to conditions on the Internet or due to any error or malfunction of equipment or systems which is beyond our reasonable control. AXP is not responsible for any computer virus or damage caused to a user's Computer by accessing the website.

You are responsible for obtaining and maintaining all telecommunications equipment and services needed to participate in the Programme Offer and access and use any websites provided for this purpose.

AXP reserves the right to suspend, cancel or terminate any Programme Offer if any fraud, technical failures or any other factor impairs the integrity or proper functioning of the Programme Offer. AXP also reserves the right to close or modify the Programme Offer(s) at any time on reasonable grounds. In the event the Programme Offer(s) are modified, suspended or terminated, AXP will provide notice thereof on this Registration Page.

F. Fraudulent and Abusive Activity

You agree to immediately notify us if you suspect fraudulent or abusive activity. If you so notify us or we otherwise suspect fraudulent or abusive activity, you agree to provide reasonable cooperation to us in any fraud investigation and to use any reasonable fraud prevention measures we prescribe.

AXP reserves the right to disqualify any individual suspected of tampering with any aspect of a Programme Offer or any other current or prior Programme Offer made available by AXP. AXP also reserves the right to disqualify any individual that it reasonably believes intends to tamper with a Programme Offer or that it believes to be acting in any manner deemed by AXP acting reasonably to be improper or disruptive or with intent to annoy, abuse, threaten, or harass any other person.

G. Privacy and Security

Any information provided to AXP by you in connection with the Programme Offer (e.g., information submitted during registration) shall be governed by the AXP Privacy Policy available at http://www.americanexpress.com/uk/legal/privacy_statement.shtml. The data that we collect from you may be transferred to, stored at and processed in a destination outside the European Union and it will be processed by staff who work for American Express or for one of our service providers. This includes transfers to the US, which does not have the same privacy rules as the UK, but where AXP (and service providers as appropriate) will take appropriate steps to protect your personal information including its security. By submitting your personal data to us as part of the Programme Offer you agree to it being used by us and by our service providers (both inside and outside the European Union) all of which we will do in accordance with our Privacy Policy.

H. Changes to this Agreement

We may change or modify this Agreement, including the Programme Offer, for business, legal or operational reasons from time to time by posting such change or modification on this Registration Page. If you do not agree with the changes, you must cease to participate in the Programme Offer by not using your card at a merchant participating in the Programme Offer. If you use or continue to use your card in relation to the Programme Offer following the effective date of such change, you will be deemed to have agreed to such change and its applicability to you.

I. Limitations on Liability

Provided that nothing in this Agreement will limit our liability to the extent prohibited by law, if we break this Agreement, we will not be liable to you for losses and costs caused by abnormal or unforeseeable events, that we cannot reasonably control and which would have been unavoidable despite all reasonable efforts to prevent the event happening, or resulting from us complying with any relevant requirement under any law or regulation to which we are subject. This may include service interruptions, delays or failures which may occur in connection with the administration of a Programme Offer.

J. No Amendment of Existing Terms and Conditions For Cards

The terms and conditions of this Agreement and the Offer Terms do not amend, supersede, change or replace any other terms and conditions, notice or information that you may receive in connection with your card account, including, but not limited to, any information provided to you on your periodic statement or the agreement governing your card account. If you have any questions or concerns about your card account or the status of your card account, you should call the number provided on the back of your card or use the online customer support available at your card issuer's website.

K. Governing Law

This Agreement shall be governed by and interpreted under the laws of England and Wales and we both agree to the non-exclusive jurisdiction of the English courts.

L. Assignment

We may assign all or part of AXP's rights or duties under this Agreement at any time without such assignment being considered a change to this Agreement. We will give you notice of any assignment. You may not assign all or any part of your obligations under this Agreement without AXP's prior written consent.

M. General

This Agreement, together with the Offer Terms, represents the entire understanding between you and AXP with respect to the Programme Offer, and may only be amended as described in this Agreement except that nothing in this Agreement shall limit the liability of AXP for any misrepresentation whether fraudulent or otherwise. No waiver by us of any breach of any term or condition of this Agreement will constitute a waiver of, or consent to, any subsequent breach of the same or any other term or condition of this Agreement. If any part of this Agreement is found to be void and unenforceable, it will not affect the validity of the balance of the Agreement, which shall remain valid and enforceable according to its terms. The failure to enforce any term of this Agreement on one occasion shall not prevent enforcement on any other occasion or the enforcement of any other term. Headings and captions shall not be considered included for purposes of interpretation or application hereof, but are for convenience only.

There were earlier posts yesterday on the Discount Codes 'n Vouchers forum, MSE news. Could this be merged?

Secondly, could MSE help clarify which AMEX cards are valid for this offer, as if the cards listed under the terms and conditions are the only ones that qualify, then it looks as though a lot of cardholders will miss out.

Where did you find those T+C's? I can't find the following clause anywhere online? Those T+C's seem to differ from the ones on the registration page: https://enroll.amexnetwork.com/GB/en/ShopSmallUK2012/

Seems reasonably clear that you can do this in as many shops as you want - "Limit one statement credit per Card at each "Shop Small" participating merchant location.". Could keep us busy as there are a lot of shops.

I think this offer is open to new customers as I applied for an Amex card last week and when I used it today in Hotel Chocolat I received this e-mail seconds after making my purchase:

Congratulations. You have used your Card ending in ***** to Shop Small. You will receive your £5 statement credit in 3-5 working days.

Remember – there’s still time to Shop Small again, right up until 30 November 2012. And when you spend £5 or more one time at each participating business location, you'll receive a £5 credit on your statement. The T&Cs were copied and pasted straight from the card registration page. They were inset (small box with a scroll bar) at the bottom of the page.
