Flight delay compensation

We recently paid for two relatives to fly with FlyBe from Leeds/Bradford airport to Southampton to attend our sons wedding. The flight should have taken approximately one hour but to cut a long story short, after one flight cancellation, they eventually took off some five hours late! The delay meant they missed all the family pre-wedding celebrations.

I emailed FlyBe to express our disatisfaction with their service and we were subsequently offered 2 x £100 vouchers that can be used against future flights with FlyBe. Given this was the first (and probably the last) time we have used FlyBe the compensatory offer is all but worthless to us. Do we have a reasonable case for some form of monetary compensation? I would appreciate any views on the case.

What was the reason for the cancellation/ delay?
  • FlyBe acknowledged the first flight was cancelled due to a technical problem on their part. The replacement flight was delayed a further two hours due to a "reactionary effect" from the earlier technical issue (their words not mine!).

a "reactionary effect" from the earlier technical issue

Not sure what that means but perhaps they mean something like there was a knock-on effect such as the pilots/crew having to take a mandatory rest break.

As this was a domestic flight, and the delay caused by unforeseen circumstances, I don't see how a claim for compensation would succeed - especially as the delay was mitigated - they did fly to their destination. The vouchers are a gesture of goodwill, and whilst you don't have to accept them £200 off a flight to a non-Southampton alternative destination is better than nothing. Take it!

I dont believe that technical issues count as extraordinary circumstances

    No, they dont.

However it may be worth taking the vouchers (sell them on Ebay) as it may be a lot of hassle\time to get any proper compensation.
