Capital One PPI - stalling?

Hi Everyone.
I took a Capital one card out in 2007 via a post application. I called their advice line and explained I wasn't sure about the insurance. I was told as I was a single female with a mortgage I had to take the policy out or my application would not be successful.
I got no joy contacting them myself back in 2012, so went through a claims company. I had a letter last week from the FOS, saying they upheld my claim, that there wasn't enough info given to me at the time to really explain what the policy would and wouldn't. Also there was inadequate info, to allow me to decide if the policy would benefit me, given all the other policies I had.
I had a letter this morning saying that Capital one, was appealing this decision as there was a tick box on their postal form which made it clear that I could opted out of the insurance if I wanted to!
I have waited 2 years to get this far, does anyone know what the likelihood is that the FOS will uphold my claim?
I should also point out, that during the 2 years I have independently had PPI back from MBNA, Barclays and Northern Rock amounting to £7000.00 which has just paid for most of my wedding::j

Most Cap One complaints at the FOS fail. Your complaint has been upheld by an adjudicator but Cap One disagree with that. Based solely on the content of your post alone I can see why Cap One disagree. Although we have no access to documentation here.
It would seem strange that the FOS reject most Cap One complaints but uphold yours on reasons they do not feel impact on others. They have a good reputation for fairness in complaint handling. Largely due to historic issues. I doubt they have been hard to get a response from. I suspect you mean they have been the hardest to get a response you want from.
The ombudsman queue is another 18 months or so. So, time will tell eventually.I am an Independent Financial Adviser (IFA). You do realise that a claims company has no special powers?
They fill in the same form you do.
You could have taken your complaint to the FOS yourself.
If you have any other complaints the company will want a slice of those too.Non me fac calcitrare tuum culi0
