I think the only offence you could be guilty of is failing to display a valid tax disc.

So it would be an offence? Would the dvla automatically issue a fine?

No 'failing to display' can only be picked up by somebody physically looking at the tax disc in your car.
As far as DVLA is concerned there is no break. Old one runs out on 31st, new is bought and starts on the 1st.

To be on the safe side I would suggest that your vehicle is parked on private land from midnight 31st/1st until you have bought and put in the car your new disc

If caught on the road on the 1st of the month then the OP could be done for no tax, even if on the way to a post office to buy some.

If you apply online or over the phone you have 5 days grace for the disc to appear through your letter box, from the DVLA site: -

"I have not received the tax disc. Can I use the vehicle without the tax disc displayed?

When you apply for a tax disc online or by using DVLA's phone service you are able to legally continue to drive your vehicle for up to 5 days after the tax disc has expired while you wait for the new tax disc to arrive. This will only apply when you have applied for a new tax disc before the current one expires. You should continue to display the expired disc on your vehicle, until the new one arrives."

You could pay at PO by cheque, this would take the best part of a week to clear as 1st November is a Thursday it would take in the non banking days of the weekend.

  • Just thought i would add for others' benefits who may not know, when i asked neighbour to use drive they said you dont actually have to SORN for the first 14 days after expiry, providing the vehicle is on private land.I rang the dvla who confirmed this. Handy to know :)
Turned out i couldnt even tax the damn thing, went to PO and was told what i thoguht was my logbook, wasnt, so have had to order a new one! Hopefully it will come this week. Car is on drive untill then!
Thanks for all the replies :)

No, my car tax renewal was due 31/10/12, and I read the back the of the V11 renewal form, and it states:
If you can't tax on time
we accept that it is not always possible to tax your vehicle on time, for example, when getting an MOT or insurance or your vehicle. By law, you as the registered keeper will not be committing an offensive if you tax the vehicle or make or SORN within 14 days of the date your current tax disc or SORN runs out. You must keep your vehicle off the road during this time as you will be committing an offensive if it is used or kept on the public road.
