Statutory maternity pay if being made redundant

Hi All,

I am 23 weeks pregnant and have been told this morning that our company is closing and we are being made redundant with a 90 day consultation period and then normal notice after that so I should be covered until end of February when my baby is due.

Does anyone know if I will still qualify for Statutory Maternity Pay for the 39 weeks I plan to be off work even though I am being made redundant? If so, how do I claim this?

    You probably won't qualify for Statutory Maternity Payment (SMP) but you should qualify for Maternity Allowance (MA)

    My wife was entitled to that because she is self employed.

    Providing that you qualify for SMP then it should be paid whatever happens after that. The following is from the employers' guide page 5....

    "My employee has been made redundant – do I still have to pay her SMP?

    Yes. If a woman has qualified for SMP from you then you are still liable to continue to pay SMP to her where she leaves your employment for whatever reason including redundancy. "

    I was made redundant when i was on second week of mat leave. I got paid all my SMP as a lump sum - only negative with that is it is taxable!!!
