The reason we are in a bit of difficulty at the moment is because we lost our son and had some time of work etc, this together with the funeral expenses has crippled us and the bank refused to help. I have nearly paid off the arrears on the mortgage and will do so before I go to court to defend the repossesion.

Unfortunately this is rarely the case with the (sh)abbey national.
It took me 11 months to get them to send my girlfriend her statements. They then had the cheek to say when she wasn't receiving them that she should notify them - which she did, at least twice a month. Their response to that? It was her responisibility to go into the branch and request a copy each month. Which they charge a fiver for.
So sorry, but no they don't always give advance notice.
And, as the charges are illegal I fail to see what your point about the contract is?
Its about as binding as my following statement.
"By reading this you are legally bound to give me your house."

brilliant now get on with the bank charges and don't stop till you get the full amount.
now they can't come on you for repossesion straight away if you fall into arrears again they have to start the prossess over again.
but hopefully that won't happen.My Mission today is to have an opinion on everything.
