    This was my point last time, but it somehow got swung round to me being part of an un-evolved breed of the human race who sits in spending his low yearly income on special brew.

    Put it this way. If we get all upset about banks and other business making a profit we will all have problems. We live in a capitalist society and if you stop one area of banking profit they will find another way of getting you. Most likely they will get rid of free banking So tell me why we should approve of a few people ruining a good system for everyone. The only people who get these charges are people who breach their contract so why reward them at our expense. In the OP's case even if he does win it will be interesting to see if he ever gets a mortgage at a sensible rate again.

    Go for it and claim your bank charges back, its your money. It has nothing to do with the fact your in a bit of bother with your mortgage company thats a seperate issue.

    If you pay the arrears before the court date they can't reposses your house, you need to go to court when you have paid it and the judge will put a stop on it. Go to your local county court and they will help you fill in the paper work.
    As for the counter claim I don't think you will be able to do it as the mortgage side will be run separate from the banking side, you will probably have to make a separate claim.
