    Hi
Just to confirm that whoever set up the finance are the ones who you pursue, so if you used a dealer to do this, they are the ones responsible.

Therefore the dealer/broker pass on the application to the lender, and the lender are the one's who take your monthly repayments.

In your case, if your finance was set up by Available car, the lender of the money was Capital Bank, but you would still have to send your complaint to the dealer.

    Hope this makes sense.

However, you can cover both grounds here and pursue both, in case you get the one coming back to say "no you pursue the other", it's up to you.

You can do this by completing a reclaim questionnaire, below link, send, keep copies in case you need to refer back to the case at some point.

You should receive acknowledgement by post within a week maybe 2, and they should also let you know of when you should hear from them next.
They do though under the FSA guidelines have 8 full weeks from the start of your complaint to provide you with the final decision.

    Good luck.

  • Hi kez you need to call the bank of Scotland as they are part of capital bank plc. I had a loan from them for a car in 1998 to 2003. The number is 08456014034. Call to complain and they will start the complaint and give you a decision within 8 weeks. No need to fill any forms in as Long as you have your agreement number.
  • BOS/Halifax are in the process of writing to me saying my complaint re a capital bank loan from 1997 has been upheld and offering me £5400. I had to do a bit of research myself but the effort was worth it
