Hi just looking for a little advice
I bought a DVD boxset on the 18th paid straight away as it was bought for a birthday this wednesday (31st) so bought to make sure it had plenty of time to arrive.
Seller marked as dispatched on 19th and sent a message to say they would forward tracking number when they got home from work.
No contact from seller after that.
It had not arrived as of yesterday so I messaged the seller to ask if there had possibly been a hold up and could they please forward tracking number so I could try and find out if it was being held some where.
Seller replied saying it was posted and they are not a liar so will not forward the tracking number because it is not for my eyes only theirs.
I replied saying I was asking for it because the item was a gift and needed to be here this week.
The seller then sent a message saying that everyone claims items are gifts well buy it from the shop because they are not a shop and don't do refunds.
I opened a case and put I'd prefer a full refund as I don't think they will send another out in time and I will have to buy another boxset or a different present before wednesday.
The seller has now messaged me twice this morning calling me a scammer and saying I wont get a refund because all scammers ask for refunds rather than the item re-posted.
Was I right to open a case and ask for a refund or should i have asked for a replacement?

You had every right to ask for a refund instead of a replacement.
If/when the seller does send another DVD, all you need to do is to refuse to accept it from the postie (if sent recorded).
The tracking will then show non delivery and you will get your refund.
If it gets delivered and there is no sig needed and you still don't want or need the dvd, simply keep quiet about it until you have received your refund, then contact the seller informing them that it has been delivered, and when they send a payment to cover the postage costs, you will return it back to them.
As to the seller.
I would be tempted to reply to their e-mail telling them that they are the real scammers as they stated that the original order was sent by a trackable method, but this doesn't appear to be the case, so they either lied about the postal service used, or they didn't even bother sending the goods.0 -
And as the seller "isn't a shop" it should be unlikely that they will have another to send you, I would think?0

Many sellers who claim that they "aren't a shop" have to have those claims taken with a large pinch of salt.
Not being registered as a business seller doesn't mean that you are not one, and for the seller to imply that they would be able to send a replacement "and saying I wont get a refund because all scammers ask for refunds rather than the item re-posted."
leads me to think that they are indeed a business.0 -
