TV design fault question

if a product has a design fault (a tv power switch) and after 2 weeks the design is changed...when that product brakesdue to the design fault can you request a new one as it is a design fault and not a wear and tear fault....ive had my tv repaired twice both times the engineers have said it a design fault and not us braking it but comet where we bought it are refusing to aknowledge anything..it has broken again so comet are telling me to take the tv in for repairs so i will be without a tv..the tv cost £649 i also got an extended 5 yr warrenty)
