Threatening to suspend my brother for not having a passport?!

They want right to live in the UK, he took in his passport the first day he started because they said they needed it.

Well, he's misplaced it, and they asked for it, and threatened to suspend him until he brings it in.

Can they do that? What do people who DONT have passports do?! My mum's never had a passport in her life.

    The employer will be checking 'right to work in the UK' which is a legal requirement and failure to have the evidence comes with a fine from UKBA. If your brother can't prove it then his employer has to suspend him.

    BUT you can prove right to work without a passport although that is the easiest way to prove it and why employers often ask for it.

    See page 14 and 26, specifically list A and list B evidence. This details which combination of documents can be presented in lieu of a passport.

    In short a birth certificate with his P45 or P60 would be sufficient unless he isn't a british citizen then the evidence will be different.

    Companies sometimes ask for 2 forms of specific ID such as drivers licence or passport and if the person doesnt have photographic ID they may accept 5 types of non-photographic ID.

    If providing this ID is a condition of his employment it sounds like they could suspend/not employ him.

    Well, he offered his drivers license and tehy said that wasn't enough and only his passport was adequate. Tesco do my head in.

    Kat - if you look at my link you'll see that a driving licence does not prove eligibility to work in the UK. Tesco are not trying to be difficult, organisations like Tesco are targetted by the UKBA and they can't be seen to fail audits, plus the fines for employing illegal immigrants are significant.

    No, he's not an immigrant. He was born in Glasgow, lived in the UK his entire life.

    Why else would I even discuss his passport? Don't immigrants need more than a passport to live here?

    Also, I don't see any problem with my punctuation, paragraphs or capitals. FYI.

    I think it has to be the extended birth certificate not the short one because the short one has been vunerable to forgery apparently. Good luck. Hope you can get it sorted quickly because I'm afraid to say Tesco could dismiss really quickly on this one so your brother should tell them (perhaps in writing for an audit trail) to explain what evidence he'll be supplying and what he has to do to get it.
