Has anyone challenged THE CUMBERLAND BUILING SOCIETY for bank charges? I'm currently taking The Cumberland to court for £1429, but i've been looking on the site & havn't came acrosss anyone challenging them.

  • Has any one taken Cumberland Building Society to small claims court? I am now at the stage of court appearance and they have filed a defence and counter claim to recoup their costs for 300.00. Any advice would be welcome as I am terrified of having to pay them money I do not have.

    I am challenging the Cumberland at present, and have gone throught the whole process with no offer of refund. I am know waiting for a court date, as they have filed a defence and counter claim against me. I am know wondering if I will get no settlement as well as having to pay out more money, good luck and if you learn anything new please let me know, cheers.

    Any way i was just wondering if you can claim your charges back if you are with a building society?? As i am with the cumberland and have just found out that in total they have charged me over £2000!!!! and as you can imagine i would like my money back as it is mine!!!:confused:

    Only the 2 posters I can find that are claiming from the Cumberland I'm afraid.

    Read Martin's article and the Reclaim Help Thread and start your claim as if it is a bank.
  • I'm also looking to reclaim from the Cumberland. If anyone has news from there claim agaist this Building society it would be appreciated.
  • Hi I realise this thread is a few years old but literally can't find anything about other people wanting to reclaim from them .. can I ask how your claim went as I'm currently just going to start the process by asking for all my charges .. they have not been sympathetic in the past and so am not expecting them to be now .. thanks xx

    The reason would be that the banks won their case before the Supreme Court in 2009.

    There is no process for reclaiming bank charges. Although, there is a bank charges reclaiming guide here on MSE.

    The bank charge guide on MSE is unfortunately outdated and while I appreciate that MSE / Martin is a consumer champion, his / the site's enthusiasm here is misplaced

    OP you will not be able to get back any historic charges relating to "unfair" billing, the banks won the supreme court case in 2009 effectively ending the route of getting back old charges.

    Current financial hardship where you are still with the bank will be considered on a case by case basis.

    Sending a list of all your old charges will simply get a polite letter back referencing the 2009 case

    Historic (old) bank charges are not reclaimable from any Bank or Building Society. Only current financial hardship cases are refunded and, even then, typically just charges from the last six months.

    If you are no longer a customer of this Financial Institution there is no point contacting them at all

    How long ago did you last ask? Surely they explained why they rejected your request last time?
