New flat - Car towed

I've just brought a new flat, got the keys the other day. Went round yesterday to check the flat out and give it a good clean. Parked my car in the allowed parking space, but i didn't notice the sign that said you needed a permit because i was carryng loads of things into the flat. When i came out they had towed my car away!

I rang the company and explained that i've just moved in, he just started shouting at me and i was so upset i couldn't speak to him and ended up hanging up. They want £300 punds from me - i can't afford it, i really don't know what i'm going to do. Each day i leave it there it goes up by £35.

I rang the managing agents to see if they could help - but they can't.

    Do you get a permit with the flat ? Surely if you had taken over the falt at that time you had a permit but it was not displayed so to speak.

    Try citizens advice or use up the free consultation time with a solicitor to see what they say.

    No one told me that i had to get a permit, i only noticed the sign after the car had been towed.

    I can't beleive that i have to ay £300 to get my car back even though i own the flat and have an allocated parking space!

    Seems to me it depends exactly how this parking permit works. If you automatically have the permit as part of owning the flat then you need to tell them you do have a permit, that they must return your car immediately, and that you will invoice them for any damage. On the other hand, if you have to apply for the permit now that you own the flat, then they'd probably be justified in removing your car. The question is whether you actually had the permit at the time. Also relevant whether you have to display a permit inside the car - even if you own the permit, if it's not displayed then they can probably remove your car. Good luck with them, though.

    Sorry to hear this. Unfortunately this is not quite as simple as having the space on your deeds (it probably isn't actually).

    On the other hand, as this is a flat, you must have a lease with the landlord that says you only have a right to use the parking space. This is exactly how it works where I live. In that case you are subject to the conditions that are normaly set out in those boards (that I agree are not always visible ...).

    This is the case where I live: the board says that not only you must have a permit, but it also must be displayed prominently, so if your permit falls, you get clamped...

    Sorry to bring more bad news to you ...

    When i came out of my flat the car wasn't there and as i was looking around me i noticed the sign..I called them and they confirmed that they had taken it.

    My Flat is in uxbridge, i'm not sure if i can name the company.. the man was so rude to me. I called my solicitor yesterday and asked him to try and get my car back without me having to pay, but the clamping guy wasn't having any of it - he kept saying that i was rude to him!...

    I've had to borrow some money from my parents to get the car back. am really gutted about the whole thing.
