Claims for PPI greater than 6 years old

Hi,

I was aware I had PPI on a credit card and two mortgages in the past, but could not find the paperwork so didn't think it worth making complaints. I had pre-existing medical conditions, that I am now aware, the insurances would have probably been void anyway. No exclusions were ever discussed. Received a very hard sell especially on the MPPI's, in actual fact, was told no mortgage offer would be forthcoming without having it in place. I was also in full time employment and had full sick cover.

However, I've just recently discovered old HSBC credit card statements for 1995, 1997 and 2000 plus a letter from HSBC confirming the account closure in 2002. Statements show the payment protection on each of them.

I've also found policy documents for the MPPI going back to 1995 and 2001 respectively.

My query is whether claims can be upheld going this far back as most of the threads on here discuss a time limit of 6 years from when the FSA regulate the financial industry even if my claims are valid?

    It depends on the condition. For example, a back complaint would only prevent claims that arise from that back complaint from being rejected. That would not be something to complain about. However, cancer is something that is severe enough to invalidate the possibility of claiming in most areas.
    No exclusions were ever discussed.

    When they say yes they were, what evidence do you have to counter that?

    and again, when they say they have no evidence to support that, what evidence to you have to back up your allegation?

    On the MPPi it depends on where you bought it. If mortgage adviser or financial adviser then most didnt become regulated until 2005. Your verbal allegations are unprovable. Only the pre-existing condition could be applicable depending on what it is. On credit card, most keep the last 6 year statements. However, if you have copies of the statements, they will use those if they uphold your complaint.

    This is not the case at all.
    You can complain if you have valid and verifiable reasons for doing so. The mention of six years is typically how long lenders keep records.

    However, Mortgage PPI does not suffer from the same selling failings as credit card and loan policies, so it's much harder to make a successful complaint. You'll need to ascertain whether your particular policy would have been voided by your medical conditions before you proceed.

    Thank you, that was quick!

    My pre-existing medical conditions were having my spleen removed as a child due to severe injury and taking antibiotics for the rest of my life; viral meningitis requiring hospitalisation and some weeks off work in 1994, from which, I developed sleep epilepsy which I suffer with to this day. Of course, this is recorded in my medical notes so is provable.

    No, I cannot prove the hard sell part as its my word against theirs I guess!

    Thank you for taking the time to reply.

    I'm aware its difficult to gather concrete evidence - I should think most claims cannot prove what happened at the time they took out PPI - the financial institutions/salespeople are hardly likely to write on any documentation that they adopted 'hard sell' tactics in order to receive juicy bonuses. However, it is generally recognised that this is what was happening otherwise certain company's would not have been fined and others would not be setting aside billions anticipating future claims.

    Any complainant can only submit their evidence based on the facts/documents they still have with a description of what took place.
