Merry Hill Parking Ticket

Hi there.

I have received a parking fine for parking in a disabled spot at Merry Hill Shopping centre West Midlands.

I was with my disabled son at the time and I parked the car in a disabled bay with the badge on my dashboard but due to me dealing with my son, I didn't open the case that the badge was in and consequently I am now being chased for £130.00 off a company called Debt Recovery Plus Ltd in Dukinfield.

I have emailed the company with a copy of my sons blue badge and explained that I did display it. All they are interested in is getting the money from the fine and said they are prepared to reduce it from 130.00 to 100.00 as long as I pay before 6/11/12.

I remember seeing Martin Lewis on Daybreak not so long ago talking about parking fines in malls as Merry Hill.

What should I do, I don't work as I have to care for my son and can't afford this amount of fine.

    It's not a fine. Only the council and police can find u

    It's toilet paper at best,

    Ignore debt recovery plus. They won't do anything as its all bluff n bluster. So treat them like any other scammer.

    They will say they have firm instructions to take you to court buy they don't
    For everthing else there's mastercard.
    For clampers there's Barclaycard.

    What you should do is cease all correspondence and ignore them.

    The Blue Badge Scheme does not apply in private car parks (check the handbook!), the only moral requirement for parking in a disabled bay is if you are (or have with you) someone who is disabled.

    'Not displaying the badge' in a private car park is meaningless as a misdemeanour.

    Not only that, but even if you had committed some kind of misdemeanour, the landowner (NOT Debt Recovery Plus) would only be entitled to the financial losses incurred. Which is zero.

    So, on many levels you owe Debt Recovery PLus absolutely !!!!!! all.

    They know this, so would not attempt court action in a million years, but will still send you threatening letters to that effect as all they want is your money.

    Ignore them from now on. Eventually they will give up and go away.

    Well I would look to sue Debt Recovery Plus - you can do this in the Small Claims Court but I suspect that Debt Recovery Plus would actually pay you before Court anyway. We have at least one poster on here who has got damages out of DRP of a few hundred quid; you deserve similar IMHO.

    You have proved that your passenger was disabled, so for an agent of the parking company to continue to harass you is a breach of the Equality Act 2010. If a company 'knows or should have known' that a person is disabled then it's illegal to harass you or your son (and demanding unwarranted fake fines is certainly harassment!). DO NOT PAY OF COURSE!

    I would start with a 'Letter Before Action' to Debt Recovery Plus and a copy to the Parking company and a copy to the owners of Merry Hill (it's not Savills is it, they have been known to force a PPC to pay a victim for harassment!).

    If you want to do this then please reply and we can help you word it. You can get damages for this illegal harassment.

    Please follow coupons advice above, if you need help drafting a letter please let us know and we will help you. What they are doing is trying to intimidate you illegally they know this.
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    Yes you go and sort the money thieving scum out there just a small wedge of a big wedge of scumbags that trys to scam people like you julie :money:
    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:
