You'd have to weigh up a lower but certain figure against the chance of getting a higher figure if you pressed them and / or take them to court.

If you have motor legal cover you could get them on to the case (but that means there will definitely be a "claim" in your history.

I successfully claimed 100% of the costs of damage caused by a pothole, from the council, some years ago.
