Extreme GB delivery wait

I ordered a watch from this company at the beginning of March as my old one had broken and they had a close model. On the website it said it should be despatched within 2-3 working days. A few days later the money had gone out of my account as I expected, but then I got an email saying they were trying to get a definite delivery date from Timex, I figured it was annoying and just left it. Unfortunately I'm still waiting.

There's some bit on the website that says paying the money doesn't constitute a contract, that only happens when they send the order confirmation, is this allowed? And does it mean I can't get my money back? or can I just ask for the money to be refunded as it's been more than 30 days? I have an order number, but can't find any email from them stating it is an order confirmation. This is the address of their terms and conditions. http://www.outdoorgb.com/terms.asp

I'm thinking of sending a query/complaint about the service.

Any advice appreciated.

    Well I sent a quick query about despatch date and they said they still didn't know, so they're refunding me. I'll let you know if and when it arrives, so I can say whether or not they're trustworthy.

    Probably depends on how their website works. If it's not linked into their stock system then you paying your money is arguably not the point at which a contract is created, because if they then didn't have any in stock then they'd technically be in breach of contract. Remember that two of the key points in any contract are the offer and the acceptance, and that a shiny website with a picture of a product on it along with a price is NOT an offer. Neither is anything on a shop shelf. The customer makes the offer, and the retailer accepts it.
