    Coming into force in accordance with regulation 1
    The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 3(3), 5(3), 12(4) and (5), 14(1) and (1A), 16(1), (4) and (6), 17(2), (3) and (5), 20(4) and (5), 28ZA(2)(b) and (4)(c), 28ZB(6)(c) and (8), 28A(5), 28B(2)(c), 28C(2)(b) and (5), 28F(2)(b), (3)(b) and (5), 28G(2) and (3), 42, 51(1) and (2), 52(4), 54 and 55(1)(b) of, and paragraphs 3(2) and (3), 4(1) and (2), 5, 5A(6)(b), 7(3), 8(2), 9, 10(1) and (2), 10C(2)(b) and 11 of Schedule 1, paragraphs 2, 4 and 5 of Schedule 4A and paragraphs 2(2) to (5), 4, 5 and 6 of Schedule 4B to, the Child Support Act 1991(1).
    A draft of this instrument was laid before and approved by a resolution of each House of Parliament in accordance with section 52(2) and (2A) of that Act(2).

    So, can anyone tell me

    a) When CMEC comes into force.
    b) Is the '20' rule only applied once your case is transferred from CS1/2 onto CMEC and recalculated or straight away as soon as CMEC is passed as law?

    I ask as my son is at 6th form college and 19 in January. He was due to go to uni this Sept so I thought I would have my case closed (I am on CS1) but he didn't get his grades so is at college another year. I thought I would only have to pay until January when he is 19 but from reading this thread it sounds like CMEC is in from December? Surely they cannot apply CMEC rules until you are actually transferred onto it from CS1 or CS2 though??

    Who knows, we have, for the second time, this year, finished paying child support. Qc has just turned 19,,, however, according to rumours, once the raise to the age of 20 comes in, the pwc can reapply untill the qc "child",,, i use the word child lightly :s turns 20!!!!!

    The 'child aged 19' is a change to regulations, so it affects all cases on all schemes - it's not 'CMEC rules' as such (also, CMEC doesn't exist, the CSA is now the Child Maintenance Group).

    It will come in when the 2012 pilot scheme begins, which is next month.
  • as things are at the min the only way maintenance would be due after a childs 19th birthday is if there are arrears owing from when the case is open

    That might work well for me then as my ex turfed out my D one month after CSA and child benefit stopped.So as she is now living with me I can start a claim against her - is that right?:D
  • that would be right jones, providing , the ex earns over £100 a week i think it is., however, we have been in your shoes, our sd moved in with us, yet with a little bit of bribery and a lot of empty promises she moved back home.

  • surely if the ex closed the account with CSA all 'arrears' would be lost and she would have to wait 13 weeks to reapply as a new case so she would lose out wouldnt she ?

    Arrears wouldn't be lost at all! Just like any debt,they don't just disappear!
