I'm new to this forum and looking for advice for my sister in law.
She currently took out an agreement with Perfect home for a two suites. She was making regular weekly payments then she got home and contents insurence, so she requested that her extra payments for cover etc be stopped and she would just pay the remaining amount on the two sofas.
Keeping in mind she has payed nearly £400 so far but last week she missed a payment due to a family problem, so then the constant calls started when she was dealing with what happened and told the store she would pay 2 payments in the following week. So the day the repayment was due her door gets a knock on it and its the people from perfect home telling her that they are there for the two sofas and there was nothing she could do about it. But feeling very intimidated by 4 big men she closed the door and told them that she was making a payment.
So then they sat in her driveway the whole afternoon just waiting not leaving her premises, they left her a voicemail on her phone telling her that there's nothing she can do and she's making it worse etc (scare tactics) now the store are not leaving her alone even although she said she would pay it. They even went to her dads house and her sisters address!!!!
But can they enter your property and take the sofas or do they need a court order? Im in scotland also
And can they just stay on her property and intimidate her even although she has a disabled son also? Would she call the police?

This is one of those credit deals for high risk people, if you miss payments they will contact you ceaselessly and the people who you gave as 'guarantors'. She would be better just making the payment.
I don't know what the legalities are of the way they operate. Bit it will be in their terms, so should not come as a surprise. When dealing with them don't bring emotion into it, they will hear sob stories and excuses every day.0 -
There might be something in ther terms about the goods title, it may well be they hold title to the sofas until they are paid - however they have no entitlement to enter your home!!
If they come again and remain on your property then call the police immediately!! They have no right of way and must leave when you tell them. Also log all of their phone calls and home visits and tell them you are doing so and will report them for harassing behavious if they continue.
Tell them two weeks payments will be made in one and give the the date. Then do that and continue paying as usual. If they persist in contacting you then do not allow them to intimidate you!! Simply repeat what you first told them and close the dialogue by hanging up the phone.
The only people that can enter your property are court appointed bailiffs, in which case it can only be using 'peaceful' means - but a CCJ is required for this, which takes a while.

If they work the same way as bright house, then they are not guarantors, they are simply alternate contacts in case they cannot get hold of th customer/embarrass the customer in to paying.0 -

And follow through. They will not take this to court as the judge will see them to be acting unreasonably, due to an offe of payment already having been made for a reasonable time.
These people are using scare tactics, and have no right to enter your premises without your permission. It is worth recording (dictaphone, mobile phone etc) that way, if they make any threats etc there will be evidence. These people are not above threats and lies, in fact, my next door neighbour once had dealings with Bright House. She said "go away, leave me alone" to which their 'collector' (these men are not bailiffs, nor do they have any legal powers) replied "what was that, you're going to get a knife if I don't go away? I'm calling the police"
When the police turned up, they were all ready to arrest the neighbour for breach of the peace and threatening behaviour, until myself and the other neighbours explained what had happened. Happily, the BH guy was arrested for wasting police time.0 -

Hire purchase means that the goods remain the property of PerfectHome until the last payment has been made. You cannot sell the goods for the duration of the agreement. It also means that we can ask you to return the goods if you don't make regular payments.
Hire purchase agreements are regulated by the Consumer Credit Act 1974.

Good find. So although we can agree title may remain theirs, it needs to be determined their rights to entry - which despite it being across the border I suspect it would be very similar.0 -
I visited a PH store on the 18th Feb. today is the 11th March and i am still waiting for the sofa to be delivered. The are completely unhelpful and basically could not careless. I called today as theyre customer service dept said they was having a delivery in yesterday (which i thought was odd as it was a sunday) they still have no idea when my sofa will be delivered! i cannot get my head around that i am paying for something that i have not got! I asked them to make a note that i would be paying 100 quid tomorrow, my weekly payment is 18.20 so i thought i was being sensible paying 100 a month, to clear it off sooner. They still called me this afternoon to see when my payment was going to be made. The are rude and abrupt and theyre customer skills are none existant! I have googled them today and read scary tales of harrassing phone calls, men in white vans turning up demanding the goods back and well what want to know is can i cancel this agreement? and is so will i get my money back, so far i have paid 3 weeks payments totalling 54.00. Please help.
(to make matters worse, i accidently left the agreement pack they gave me on the bus...... a silly mistake i know)

Go into store first thing tomorrow and tell them that as they have failed to deliver your item that you wish to cancel and receive a refund of all monies paid.
If you want a copy of your contract you can just ask them and they should print one out for you.
Get your money back, plus the £100 you're planning to pay, and buy a second hand sofa. I got a fantastic real leather corner sofa bed that retails at £1100 for £180 delivered just last week. Much better than having to pay through the nose for one of their poor quality suites (look around, there're lots of complaints about their sofas). Then put your weekly payment aside to save up for a brand new one if needs be.0 -
I did contact the store the following day and advised them that I wanted to cancel the agreement. I thought they would give me a load of grief but said that was fine, i just need to go into the store and sign. They refunded all my money and gave me a copy (when i asked) of the cancellation notice. I feel very relieved! They was very arsey with me but they have always been the same. My advise to anyone considering using this company IS DONT GO ANYWHERE NEAR THEM!0
