HSBC want proof that ex partner still lives with me?!

Hi all,

My ex and I took out a joint loan (with PPI just in his name) a few years ago and having had no contact with him for a while I recently managed to locate him and agree on a deal, should we be successful with our claim against HSBC.

I sent the claim off but they have written back to say that they can't proceed yet as his address differs from the one we used to live together at (I'm still there) and could he go into branch with ID showing that he still lives with me?!

He now lives with his mother so the only bill in his name is the mobile phone, plus his driving licence. They said that he had to take a utility bill with his name and OUR address on - even when we were together all the bills were in my name so we'd have been stuffed even if we were still together when claiming!

He went into the branch yesterday with ID to try to explain that he fully authorises the claim and that he is who he says he is but that we no longer live together (he didn't say we had split up, just that we live apart) and also took recent ID of mine showing my address, something he couldn't do unless he was still in contact with me, but they wouldn't accept it.

I can't see why or how this matters tbh! We are both in agreement about claiming so I'm a bit baffled about it! It's like they are trying to wriggle out of it IMO - any thoughts on what we can do?

Thanks :)

His current address is irrelevant, but it does look like he'll have to show them some ID in order to get the ball rolling. Why did he give a different address for the complaint? All a joint complaint needed was two signatures.
  • Thanks for the fast reply :)

When I applied I just used the template on here and put the one address as the form doesn't leave a gap for 2 different ones, so I presumed that as I was the one filling the form in that my address would suffice. I just used my address and never gave a second thought about him being at a different one.

As well as taking his passport into the branch, and I.D of mine as well, he took the letter that they sent to me that asked for additional ID. If he didn't live at that address or have contact with me then he wouldn't have had the letter in hand surely?

He signed his name on the claim form and his passport sig of course matches it. Not sure what to do now. If I say that he's at a new address are they likely to refuse the claim on a technicality?

They must have learned somewhere that his current address is different. Write them a letter explaining this. I can't see them making any more of an issue if what you say is simply the truth.
  • Yes, he told them of a different address when we split up as he used to bank with them as well.

Right, I guess another letter is in order then! He can prove who he is, where he now lives and also that we agree to the claim so hopefully there won't be anymore problems.

Thanks for the useful advice

Good luck with your (actual) complaint!;)
