applied for DLA in aug 2011 , was refused , and to cut a long story short we appealed went to tribunal and won , got awarded middle care and lower mobility , been told via welfare rights we will get backdated money for DLA cant think back to aug 2011 if we claimed for carer's allowance , i thought we did but cant be sure , or if i tried and was told we couldn't until we were awarded any DLA , does anyone know if carer's allowance can be applied for at same time as DLA and be refused the same time as DLA , or you CAN NOT apply for it until the DLA as been awarded what makes me think i did was my wife had to put her bank details in one form we filled in and im wondering if that was the one after 14 months of being messed about my head is all over the place with paperwork for appeals and tribunals , we have yet to go to another tribunal for the ESA now as that too was claimed in aug 2011 and is still in assesment phrase and was stopped for a week when we went to atos medical until we again appealed (still waiting on that one ) if anyone can advise on this matter i would be very grateful thanks

carers is usually payable upon reciept of DLA and AA.
i dont know if you would be entitled to claim the back dated cash of CA because rightfully you was not in reciept of the benefit to be elagable.
CA can take a while to process, so a small back payment will be due anyway.0 -
If your wife has been providing care then it would be fair if the carers allowance was back dated. When was anything ever fair with the UK benefits awards?
Good luck with your ESA appeal."A nation's greatness is measured by how it treats its weakest members." ~ Mahatma Gandhi

CA and DLA can be claimed at the same time and also disallowed at the same time as DLA must be in payment at High Rate or Middle Rate care component for CA to be considered. If you have won a DLA award on a tribunal decision then reclaim CA ASAP from the start date of the DLA award - if this is a Wednesday claim from the Monday of that week. You would have to fill in a claim form (0845 6084321) or online - this MUST be RECEIVED at the CA Unit within 3 months of the tribunal decision or backdating rules apply. If you dont get backdating please consider an appeal.0
