The OP says the damage "wasn't their fault" they're not saying it wasn't damaged. From that i would assume that the OP knew about the damage but thinks they shouldn't have to pay for the repairs ?

Disagree s75 wouldn't apply. If the OP's claim is that the rental company has made a further charge outside of what was agreed in the T+Cs, then that's a breach of contract.
No doubt the T+Cs are drawn very widely, but they would be subject to unfair terms regs.0 -
Can't see any breach of contract here at the moment.
As all car hire companies operate the same way i would imagine it would be very difficult to argue unfair terms regs.0
