    The OP says the damage "wasn't their fault" they're not saying it wasn't damaged. From that i would assume that the OP knew about the damage but thinks they shouldn't have to pay for the repairs ?

    I agree, not enough information to offer any specific help really.

    Disagree s75 wouldn't apply. If the OP's claim is that the rental company has made a further charge outside of what was agreed in the T+Cs, then that's a breach of contract.

    No doubt the T+Cs are drawn very widely, but they would be subject to unfair terms regs.

    Can't see any breach of contract here at the moment.

    As all car hire companies operate the same way i would imagine it would be very difficult to argue unfair terms regs.
