    Is the pavement STILL in the same state? If yes (after 3 months) then on the balance of probabilities the owner already knew about it and did nothing, and that OP was not the first to come a cropper on it (maybe just the first to pursue a claim).

    The paving dip where I stepped into is still in the same state. All the parking bays are marked and paved. It is privately owned as I'd called the council to repair it and they said it did not belong to them. There is a row of shops and anyone needing to go to any of these shops would park in this carpark. I'm sure I'm not the only one who's tripped up.

    Quick update, the solicitor has emailed me. He basically said that win or lose, it will not cost anything to make the claim. I've done the email as an image as I don't want it to be searchable and I can't post the link as I'm new. Sorry I had to put in spaces or it won't display - w. w .w.t inyurl. c o m/8fgqnhc

    ATE insurance will only be available upon a supporting Counsel's Opinion of a case with good prospects.

    Equally, a CFA solicitor isn't going to take on and run with a case where the prospects are poor.

    Therefore, I would suggest you should proceed for the time being. If it later transpires that the prospects of success are poor, the lawyers involved will take the hit - not you.

    Thank you Equaliser123 (no more Thanks button to press)! I really do appreciate your time and advice. I've talked to hubby about it and he thinks the same as you too. I'm re-reading as I'm a bit paranoid now having missed small but important text.
