EPC for private sale

Hi
We are selling our house to my brother....we've owned the house 10 years.
Obv we r not selling thru an agent. Got the solicitor pack today and it says we need to enclose an EPC.
With a private sale.....do we need to do this? And do we just search an EPC company or something?

Hi Cara79. You will need to do this. The directgov.uk website states "If you’re selling or renting your home, you must order an EPC for potential buyers and tenants before you market your property."
We are selling without estate agents too. I just arranged an EPC for my late father's house yesterday. I found a website called epccompare.com and easily compared the cost of suppliers in the area. The cost depends on the size and type of property and averages about £45 in the Herts area.
I sent an email to a local supplier, he called me back within an hour and it's being done on Monday.

XThe EPC is a compulsory document which a seller or landlord must by law provide when putting their property on the market.If you’re selling or renting your home, you must order an EPC for potential buyers and tenants before you market your property.
Whether this means you don't need an EPC I'm not sure. Would be interested to know though.
edit: new rules from March 2012:
Meaning of "put on the market"
Under the rules, a building is put on the market when the fact that it is (or
may become) available for sale or rent is, with the intention of marketing the
building, first made public in England and Wales by or on behalf of the seller/
landlord.
The rules go on to state that a fact is "made public" when it is advertised
or otherwise communicated (in whatever form and by whatever means) to the

When I sold a house earlier in the year, I am sure the agent said an EPC is not required if you're selling to ..... and that's where my memory fades. It's either not required for a private sale, or to family. But, one or the other, or both, apply.
Edit: Just googled, it's definitely required for a private sale....
