Asking for compensation from a landlord

Dear all,

I am thinking about asking for a compensation from a landlord who failed to give me a flat.

I rented a place in north greenwich back to 25th August via Foxton; however the landlord of that place failed to give me the flat on the date when I moved in. Since then I refused to further using Foxton and the landlord's alternatives.

Now, I have all the legal documents --- short-term tenancy agreement and preparation of property fo tenancy. All these legal documents have the landlord's and my signatures.

The only catch of those documents are photo copies and Foxton was being a dodgy and didn't give me the original ones.

First of all, can I still ask for a compensation? If so, I am thinking about sending an email to ask them to pay me 600 pounds (including short-term living cost in B&B and moving my belongings from my old flat) for the compensation. If they don't want to do so, I want to take them to a small claim court.

I have been looking up on the internet, I can't find a sample letter for this kind of compensation. It would be great if you have provided me a link for this.

Also, regarding to the small claim court, how can I apply it?

    What do you mean the landlord failed to give you the flat? What happened and how much notice were you given? Technically the tenancy does not begin until you take occupation. What did you refuse, an alternative flat? Do not send an e-mail write to the landlord, send two copies from different Post Offices, getting a proof of posting each time.

  • Thanks for your advice, I am being a muppert. I did call up the landlord regarding the compensation.... Damn I think I made a mistake.

    1.) the date when I was supposed to get the keys of the flat the Foxton agent called me up saying to me that the flat had been rented by another tenant through another agent.

    It is a very long story. The landlord employed different agents to help him to promote his properties. I cut the long story short. He signed another contract with another agent which allows them to take the full control of renting the flats. Although he signed and agreed to rent his north greenwich place to me via Foxton, he could not give the flat to me because another agent had moved in another tenant.

    2.) Yeah, he offered me an alternative flat but it was very tacky and not worth for any penny.
