Excel PCN - Appeal Failed - Help!!

Hi,

I have recently received a parking charge notice from Excel. I initially ignored the PCN hoping they would not follow it up, but they did, and as I had missed the initial payment period the charge increased to £100.
This may be wrong, but I appealed the charge on the grounds of inadequate signage as I felt they not followed the BPA code of practice - there were no signs viewable where I parked. Needless to say the appeal failed and they are now demanding payment by 23rd October, stating failure to pay 'may' result in court proceedings and further costs.
What should I do??

Thanks in advance

PS. Could probably attach an image of my appeal and their response if this would help??

  • Date of ticket please, I nearly said FINE Ooops.

  • Ticket was dated 21/08/2012

Ignore anything you get except genuine court papers ( which you won't get ).

Pity it wasn't issued in October !!!!

    Precisely nothing.

Excel has just had their access to the DVLA database withdrawn for being bad boys, which just shows what chancers they are. Your appeal always was going to fail - that's their model. While they "may" take you to court, the chances of it happening are vanishingly small (49 cases in 1.8 million tickets issued last year). And with a couple of recent cases lost by PPCs, they are not winning even when they do go to court.

So, stop worrying, ignore all further correspondence from Excel or any so-called debt collectors (who are powerless to do anything) or so-called solicitors. If (and that's a HUGE "if") you get official stamped court papers, only then come back here (it won't happen).
  • Thought that might be the response, thanks all :)

Ignore, ignore and ignore some more. We have learned just today of a court case in which a judge ruled that a parking company which threatened legal action it had no intention of taking (i.e. all of them!) is guilty of the tort (civil wrong) of deceit. This is what Excel will shortly do with respect to you.
