mortgage provider not known.

Hi, in the early 2000`s, myself and my Ex wife had a Joint Mortgage for around 3/4 years, we were both self employed and i have a strong feeling we had PPI on it. We are no longer in contact and i cannot remember who the mortgage was with.

My questions are,
How can i find out who that mortgage was with?
Is it too late to try?
How would i claim back PPI without consent/signature of my ex wife.
thank you for your time. Ado

    Who arranged the mortgage/insurance?

The laugh being that you cannot remember the lender name, but remember you had PPI - its all about motivation eh!!

Solicitors you used are likely to retain the paperwork?

  • Some things stick in your mind Dave Ham,:) An independent Mortgage broker called Steve Smith from Poundsmith mortgages, Bude set it up for us but has since stopped. I`ll try the solicitor route for now, any other thoughts would be appreciated.

Why do you feel there is anything to 'claim' on?

Poundsmith IFA/Mortgages is showing on the FSA Register. One showing as EX23 8BS, Bude. The registered contact was Mrs Carol Smith.

The firm was an Appointed Representative of John Ellis IFA Ltd of Holsworthy. Their address is;-

    Bahamas
    Lower Exe
    Week St. Mary
    Holsworthy
    Devon
    EX22 6UX

and as the principal, you should write to them (FAO Compliance Manager) to raise your concerns in the first instance.

You should set out your concerns, what they did wrong and refer to the evidence you have of their wrongdoing. Suitability letters etc are the usual documents for this.

What you refer to as PPI may well have been Accident & Sickness Cover. If you paid monthly premiums for an income benefit paid in the event of accident or sickness, it's unlikely you were sold "PPI" in the terms that it is commonly understood.

A&S cover was normally sold by intermediaries and based on a recommendation built from your personal needs. PPI was "blanket-sold" with no attention given to you or your needs and the premium was normally borrowed as part of the mortgage and paid up-front as a single premium.

You really need some evidence of the cover you had and why you believe it was wrong for you. A speculative punt that it was "PPI so it was wrong", is unlikely to be successful and simply creates work for people who may well have done nothing wrong.

  • I have no records at present of any agreements of either A&S cover or PPI, so my next step surely has to be contacting the Mortgage company/companies to ask what cover i did have, gather evidence and go from there, because it may "create work for people who may well have done nothing wrong" should not mean stop what i`m doing should it?(me possibly losing money to costing them a little time)
I now have the mortgage companies names via the solicitor ( Cheltenham & Gloucester / Bristol and West, thanks for the advice Dave Ham) and will be writing letters setting out my concerns and asking for details of any agreements.Any other advice will be taken gratefully. Thanks.

If the lenders did not sell the insurance, they will have no record of it.

You need to know the name of the insurer and even that will only give you details of the cover you had if they didn't actually sell it to you themselves.

In the first instance, I would write to the IFA requesting a copy of the suitability letters for the products you purchased through its Appointed Representative. That should give you the information you need to establish if a complaint is possible/realistic.
