selection criteria & being offered a new position

Hello people,

Got my 'at risk' letter day before yesterday with about 100 of us, have a private consultation this afternoon and a final interview next week.

Why i'm on the at risk list is a bit confusing... I have more experience than most others, no disciplinary record and all my reviews and recent projects have had exemplary feedback.. The only thing i can think of is that...
What the company ask me to do and officially schedule me to do on projects, is 70% not my Job description. i.e. in my last review i was told that they were unable to evaluate my progress, but also noted that i should be very proud with what i have achieved and gave me a pay rise.. This year i have made sure that there are examples of my described job so that they can evaluate me for my next review, that was to happen shortly.

My question is that if they have used my last yearly review to evaluate my performance, can i request that they use more recent feedback from my supervisors to reassess my position?

There is also the possibility that they will offer me (nothing is currently advertised) a different job position, that would most likely be unfavorable to me.. I don't know how to respond to this apart from accepting redundancy. Do i have any other options? I know that they will possibly ask me to stay on for a month to finish the current project.

..to make matters worse its is a very small industry, with only a couple of places to work in UK and a handful of other places to work elsewhere. It's pretty much the norm that if you rock the boat and burn your bridges you would never work in the industry again. (although i have every hope that my employers are different and would not act like this - but as i have dependents, so i'm not prepared to risk it to find out)

We have no representation, everything is dealt with on an individual level. Out of everyone i know, no one has dared to even ask for the selection criteria, the numbers, or questioned any time-scales..

  • I would assume that you are in a unique position as you mainly do project work and they could argue that your position is not required if they are making organisational changes.

I am in a similar position and in other areas of the organisation it has been those one off positions that have been " disestablished". The selection criteria only seems necessary where there are several people doing the same job.

Check your initial contract of employment letter in case it outlines any of the process there.
  • Being at risk has nothing to do with how well you do your job.

An employer has to identify the 'pool' of people at risk. For example, if orders are down in a factory, the employer may need 5 less mechanics. In total there are 100 mechanic-type jobs, so all 100 would be 'at risk' of redundancy. Once the decision was made to reduce the workforce by 5, the 100 employees would be scored on various criteria and the bottom 5 would be made redundant.

You can see that there was never an intention to make all 100 redundant. Although that is the way the media often report redundancy situations.
I am an employment solicitor. However, my views should not be taken to be legal advice. It's difficult to give correct opinion based on the information given by posters.
