faulty ipods from apple

i wonder if anyone has been in the same situation!! i bought a refurbished ipod video from apple website for £129 last september..it worked fine for 2 months and then stopped. at that time i could hear clicking noises from the inside of the ipod and apple diagnosed hard disk failure and sent me a replacement. the replacement ipod worked for 4 weeks and again the hard disk failed..apple did not argue and sent me another replacement which failed after 2 weeks. i contacted apple and they offered me to collect it and probably deliver a replacement if it not repairable but i am not happy with that...this is going to be my 4th ipod in 6 months and to be honest i lost confidence in their replacement ipods. my other worry is that by september the one year warranty would have ended and then i am stuffed!!...i know the original one i bought was refurbished but i bought it from apple and it camewith full warranty so i would not expect such treatment from apple...it is also a hasstle to have a day off work once for the collection and another time for delivery and this is now causing me troubles at work...any advice please? can i ask for my money back? the customer service people say they have no authority to do that and they refuse to pass me to their superiors...ia m really angry now.

    The ipod in question uses a hard disk drive to store data, hard drives are very delicate devices and need to be treated with a little respect. I'm not saying that your abusing the ipod but it could be a cause of your problems.

    Anyway back on to your question. sales of goods act states that the goods must be fit for purpose.
    and you also should have problem free use
    If repair and replacement are not possible or too costly, then the consumer can seek a partial refund, if they have had some benefit from the good, or a full refund if the fault/s have meant they have enjoyed no benefit

    If you bought it on line then you also have the Distance selling regulations to help, they are limited in this case as they tend to be valid for only a few months after purchase.

    Your other option depends on what you used to pay for the ipod, if you paid by credit card they are also liable under the consumer credit act so you could make a claim against them for the faulty product. only if you paid with a credit card.

    thank you little john for the reply...i would like to think of myself as someone who has some knowledge about computers and gadgets as i own few and also i am sort of person who is obssessed with taking care of his gadgets (a small scratch on ipod will put me completely off -although the ipod i bought was refurbished it looked perfectly new)...on the occassions when my ipods failed i was just listening to music when the ipod just stopped suddenly..i was not trying to change songs or even touching the ipod.

    yes i paid by credit card but i think apple will argue that they are trying to repair the ipod every time there is a problem.

    You have given apple a chance to provide you with a satisfactory product how many times now? I would think that your credit card would fight in your corner on this one no problem, you have been very patient with apple so are in a good position.

    Have you sent the latest faulty one back yet? hopefully not I would make a log of dates if you can when things went faulty, dates sent away and dates you received it back. in some cases they will make deductions due to the use you have had from the product so if you can prove that over the 6 moths apple have had the many ipods 3 of them your use has been very limited. ;)

    As for the mistreatment of the ipod I was just posting incase your not a techie :) some people don't think about what is inside them its a music player and I can drop it no problem or sit on it agghhh!

    maybe you could do a search on the internet and see if there are other people having the same problem as you, there are so many ipod versions you need to check your searching for the same one, if there are others then it could be classed as a inherent fault and it makes your claim even better.

    Just for clarification: The Consumer protection (Distance Selling Regulations) merely serves to protect you from "impulse buying". If you order something but have changed your mind by the time it arrives, you can return it at your expense (unopened, unused) for a "full" refund (minus any fees the company states in its T&C that it will levy - usually you won't get postage refunded and there may be a restocking fee). Obviously this is not relevant to faulty goods, for which the other above-mentioned regulations apply.

    Ask Apple if they will collect the iPod from your place of work. Most companies will do this. In fact many prefer to do it.

    I think you've given them more than a fair chance to put things right and they've failed, so I'd get onto the CC company and try and get it sorted.
