Freehold House but £5 a year ground rent?

Hi all
We are about to complete on a house and our solicitor has told us that in the deeds there is a £5 a year charge for ground rent. She said the house is freehold and we will still own the house and the land. She is going to look into it and see where this £5 a year actually goes.
Has anyone ever heard of this?

Thanks

we own a freehold house with a "perpetual yearly rentcharge" of £2.4s.0d...

...but it is never collected - are you saying your vendor actually pays this £5 to someone?
  • I don't know if its been paid (the vendor is the daughter, it was her mums house, and her mum has died) so I have no idea if this has been paid historically, its in the deeds though...we may have to wait and see what the solicitor finds out.

when we bought the house we were paid 6 years of this rent by the seller.

We have just sold our place and the same has been offered as compensation our buyer, in case the mystery missing rent collector comes around to colllect the ground rent.

I believe that legally 6 years is the most ground rent that can be collected in arrears , therefore that is the usual deal when the house is bought & sold in these situations.

I think it is 'chief rent' rather than ground rent. I don't know the legal implications but my house is freehold and I also pay £5 pa.

If it's any consolation I believe it's being abolished in about 12 years!
