Black Horse or Availablecar ?

My husband purchased a car from Availablecar.com and was advised to take ppi insurance. The loan was with Black Horse and the insurance was with Capital Bank ltd(I think)
He filled out all the forms and forwarded them to Black Horse who finally replied saying as the loan was sold to him by AvailableCar.com his claim for miss selling would be with them and that they, Black Horse, have forwarded his claim to Availablecar. Does anyone know if this is right? Should he have sent a claim to Capital Bank as well?
thanks for any help

He should have sent the complaint to the institution that sold him the policy in the first place, so yes, Black Horse are right, he should have originally complained to Available car.

I have exactly the same thing going on, received a reply from BlackHorse saying that its not there responsability its available cars and they will forward the forms on to them, but still haven't heard anything three months later. Any advice on what to do next please we can't be the only ones? Confused where to go from here. Thanks

There's no confusion. You conplain to availablecar. If it was sold prior to January 2005, they will most likely dismiss your complaint because it's pre regulation.

If it was after, send them another letter saying you've complained and they had 8 weeks to get back to you and now you're going to the FOS.

Or phone and ask if they received your complaint.

Concur with above. You are not complaining about the PPI. You are complaining about the sale of PPI. The car dealer sold it. Not the lender.

  • If it was pre 2005 with the available car PPI does that mean there is no point pursuing a claim, as available car has told us? or is it worth going to the financial ombudsman?

You have no access to the ombudsman because it was sold prior to 2005.
