I was recently made redundant when my company became insolvent.I am entitled to the full 12 weeks lieu of notice. Am i right in believing that what i receive after the 12 weeks are up is the capped amount (£430x 12) awarded by the insolvency service less any money earned or benefits received in that period .Does it not matter if you take a family holiday in this period , does that just count towards the total of money not earned on your claim.

Is the company paying you the notice pay or are you claiming from the insolvency service?
If it's all from the Insol Service, here's what you can claim:
1. eight weeks' arrears of pay
2. six weeks' holiday pay
3. Statutory notice pay
4. Statutory redundancy payment less any amount paid by the employer
These are all capped at the current max allowed weekly pay = £430.
I don't think it matters if you go on holiday within the 12 week period. All the RPO asks is how much in benefits and wages you've earned in the 12 week period and deducts that from the PILON payment.I am an employment solicitor.
