Game - Won't swap fault game, purchased yesterday

Returning games, CD's and DVD's has always been a bit hit and miss to most stores. sometimes I have been able to get a full refund even without a recipt but the game was sealed other times they have refused to swap/exchange the item with a recipt etc. it all depends who you speak to and if they are having a good day I think. Once I took a game to a game store and got them to swap it for the same title on another platform it was still sealed I didnt have a recipt in fact it wasnt bought from game.
As for them saying it was never sold with a scratch ask them to prove it, they won't be able to. I know not all their games are sold factory sealed some are open so it is very possible the game was scratched before you bought it. yes ther eis aproblem with newer games that are using alternative coloured disks but a late 2005 PS2 shouldnt have a problem and I would bet the scratch is the cause of the problem.
Everyone is saying contact their CS I would return bck to the store and speak to someone else if it is possible and your passing.0 -
Just wanted to point out that them claiming they wouldn't have sold a scratched disk is a knowing fabrication as Game infamously keep most stock loose rather than in sealed retail units and they've been seen to sell second hand games as new any number of times. Most savvy gamers check the disk before leaving the store and I've personally made them swap a scratched disk having walked no more than a few feet from the till with my "new" game. In any case the Sale of Goods Act places the burden on them to prove the fault wasn't present at the time of sale, which as you can imagine is rather tricky and goes beyond just saying it's so.0
