looking for a wee bit of help here.
One of our units uses roughly £30k of electricity a year, i was reviewing the contracts and found that this one had not been renewed in house but instead a renewal pack had been sent to the unit address and not forwarded to our offices.
The renewal pack stated that if we didnt respond within 60 days they automatically put us onto a new 2 year contract.
Said 2 year contract has now been in force for 10 months and is at a right !!!!!! rate.
Any ideas of ways round this? surely as i havent signed anything i could insist the pack was never even received?

It's probably worth checking your original contract from a couple of years ago to see if it said in that it would automatically roll onto a new contract if you didn't cancel. If it does then you probably won't have much to go on I'm afraid. I believe there is a business forum somewhere which may offer some better advice though, not sure where it is but hopefully someone will come along and post the link for you0

Hi,
I'm a National Account Manager at British/Scottish Gas Business and the 2 year assumptive renewal is standard practice across the industry for commercial customers.
Give us a call on 0845 6000604 and ask for the renewals team in Leicester who will review the deal, they may well improve it but you will likely need to agree a new contract term with us between 1 and 3 years, remember you also can get 3% discount if you pay by monthly DD (fixed or variable).
As far as claiming your pack was not received this will not work, in your original contract as well as auto-renewal, you agreed to something called 'deemed as received' i.e. if we say we sent it to you, you agree you received it whether you did or didn't.
The onus (contractually) was on you to call if it never arrived, it clearly states that renewal documents are sent 120 days before contract expiry with the following 30 day period allowing you the right to cancel the renewal.
It may seem harsh but is legal and was agreed, all Business energy suppliers follow similar rules, many will not even entertain renegotiating midway through your renewed contract - we will in most cases.
If you need more advice, with a £30k annual spend you are likely to have been allocated an SME Account Manager, give them a call for help, you should have their business card already from the welcome pack.
