Help , How do we get adverse possesion

Hi, There is a piece of land at the front of the house which we have maintained and used for the last 40 years since the house was built, We always thought it belonged to us but we recently found out that it is not registered at the land registry to anyone. Can we claim it using the Adverse possession laws. If so can we do it ourselves or do we have to use a solicitor . Thanks for reading this, Regards Kittysboy

    How have you used it?

    Your acts of adverse possession have to be such that if the "real" owner were to appear it would be pretty obvious to him that someone was claiming possession of it.

  • Thanks for your reply, We think we have all that's needed to get adverse possession, having used and maintained it since the houses were built,cutting and maintaining the grass and surrounds,our children played on it when they were younger. and we did have a border of trees at one time which separated it from next doors land. Nobody else appears to have any claim or interest in it.Our main concern is can we do it ourselves to save money.

    The Land Registry have practice guides on things like adverse possession - see http://www.landregistry.gov.uk/professional/guides wher eyou wil need to look at guides 4 & 5, depending on whether the title ti sregsitered or not.

    Cutting grass and your children playing on it would be unlikely to be sufficient on their own to found a claim for adverse possession.
