Can you be sacked while claiming SSP?

Morning all, I have searched on the net and am unable to find an answer

Quick version is

Hubby a builders labourer started with a new company after 2 weeks injured his elbow at work, first put in self certificate, second week line from the docs - now looks like he will require surgery and be off for recovery afterwards (possibly around 2 months but cant be sure)

as hubby has only been with the company for a couple of weeks before this happening can they legally sack him (incident has been reported in the accident book and he is a member of the builders union)

We have today phoned for a claim form so we can have the mortgage paid on the insurance while he is off - have been told this has to be filled in by employer as well as doc

Anyone with experience of this I would be glad to here from

    Though there are lots of legalities around this, particularly because the injury happened at work, I'm afraid that the answer to your question is, yes.

    my mum had been with her previous employer for about 2 months was on a 3 month probabtion type thing!! she also went on the sick and yes they sacked her! so yes they can sack you!

  • Cheers. Kind of thought so, just looking at all the posibilties hopefully they wont sack him but from their side I can see why they would be annoyed

    His employer also has a duty to report to the HSE under RIDDOR...http://www.hse.gov.uk/riddor/index.htm

    "You must report...
    over-3-day injuries – where an employee or self-employed person is away from work or unable to perform their normal work duties for more than 3 consecutive days".

    Unfair dismissal only kicks in after the first year of employment so before that you can be sacked for being off sick.

    thanks guys he is off for an xray today and has to phone boss after that so will have to wait and see!
