    OP: Can you cut a deal with your employer to work through part of your lunch? Judging by your hours I'd guess you're on a 40-hour week with a 1 hour lunch. Why not cut that to half an hour per day and you're then comfortably putting in your 2 hours+ per week.

    Certainly juggling will be required with a job, OU and childcare, but it's not the employer's problem to make sure of this. Similarly the employer needs to ensure that their employees doing overtime isn't putting them in contravention to the NMW (especially if it's compulsory).

    43hr week before overtime with 30 mins lunch.

    Its something I am just gonna have to do on the weekends I guess, no other way around it.

    So I calculate that at ~£6.17 an hour (based on a £13k per annum on a 40.5 hours working week assuming an unpaid lunch).

    If you put the overtime your wage dips to £5.88, which is below NMW. This is unacceptable, salaried or no. It's a big difference between someone on £25k and someone on NMW being "expected" to put overtime in without pay.

    A lot will depend on your length of service and how much you want to rock the boat, but I think you have a strong, legal basis for refusing overtime, unless they are prepared to up your pay to NMW. Otherwise there may be an "unlawful deduction of wages".

    EDIT: Done some quick workings out, and you would need to receive a salary of £13,680 to be within the law on NMW, or those 2 hours compulsory overtime must be allowed to be taken as TOIL.

    I get paid for overtime, at same rate, problem is my Mrs gets more. By the time your taxed etc you don't even gate a tenner.

    Falko can't you go in earlier and finish the normal time that way you can fit in a few hours a night study.

    Surely you can simply decline the offer of the overtime? Presumably there are plenty of other people who would be glad of the chance to earn a bit more money.

    That would be to sensible, any other job I had I did overtime in the morn, that way it was done out of the way. But no this is a production line it takes everyone for it to function. Had all this been mentioned I'd off never taken the job but of course employer was the smart guy and didn't mention any of this. I did bring all these issues up, his response, I am keeping no one here.

    Well he does have a point.

    Whilst I appreciate your wife earns more than you per hour is that extra worth all this grief?
