truth or not the truth HELP PLEASE !!

Need advice from every one here....

in short, im up to my neck in it. I have been suspended on full pay for alligations that I and others in work commited a offence that has been classed as gross misconduct.

I denied all knowlage while other confirmed that they did it and thought it was ok to do it.

my hearing is on werdnesday, the others have all had there meetings & been given a final warning. But some have named me as knowing about the offence and have spoken to them about it in the past. One also named me as the person who shown him how to commit this offence (not true)

so Im lost.... I think I maybe able to convince someone to take the wrap for me as far as the original offence is concerned. But then is the fact I lied about not knowing anything of this allegation let alone doing it.

So do I go in there and admit everything.... from start to finish and ask to be shown mercy.

or do I get this person to take the wrap for the offence and admit I lied about not knowning anything about the offence.

or continue to deny everything still??

if some of this makes no sense im sorry im all of a panic. I could loss my job 8 weeks before crimbo with a family to feed

    OK, first of all keep in mind that to dismiss fairly (in law) an employer does not need anything like the standard of proof that would be required by a court. In fact they do not need proof at all, only a reasonable belief that the gross misconduct took place.

    Also, in real terms you do have a "right to silence". Unless you answer questions and put your side of the story you are as good as admitting your "guilt".

    Whether or not a late admission and grovelling apology will cut any ice with the employer is impossible for anybody here to tell you. It will depend on your firms policies and how useful you are to them when you behave properly.

    Obviously being honest is the "right" thing to do, you don't need us to tell you that. In practical terms whether you can lie convincingly is not for us to say. If you can, you are in a small minority.

    If you lie your employer will know you're lying and won't believe a single word you say ever again even if you don't get the sack now, and it's only going to be a matter of time, your card will be marked and you'll be out as soon as they can get you out.

    Come clean, tell them you are very sorry, apologise like you never have before. Tell them you were absolutely petrified and have never been in trouble before.
    Loss of pride for a while is better that being on the dole.
    Be prepared to prove yourself worthy.

    OP, so you'd shaft someone into taking the blame for you? Nice.

    Well I suppose that's one take on it!

    Maybe I'm wrong but I didn't read the OP that way.

    He said "I think I maybe able to convince someone to take the wrap for me as far as the original offence is concerned." I took that to mean this other chap was going to get sacked anyway and was willing to say that he also was responsible for what the OP did.

    Not exactly honest or ethical but not "shafting" either!

    no not at all.... Im thinking the other member of staff may also need to come clean.

    If he admits to one they never knew he did it could be seen as a great show of honesty on his part and put him in a better situation

    the other who admited it have all been given final warnings and have there job back.

    if i did admit it and got the boot how would that stand in a appeal.?

    I would not shaft someone to save my skin... while the others did, im not that kind of person

    If you lie and lie well you might escape with no warnings at all. A final warning is almost bad as getting sacked. Since you already lied, if you come clean now you'll get sacked 100%. See if you can pull this one off convincingly.

    if others have gotten warnings, you will need to be good to get away with nothing yourself, you will have to say the others were lying, so not only will you have to convince your bosses you are not lying but that others are lying about your involvement, if you manage to do all that, you still have to work with these people you have just accused of lying.

    You say you wouldn't expect someone to take the fall for you but it sounds like that is exactly what lying would be doing.

    A final warning is not the end of the world, it just means you need to keep your nose clean for a while.

    If the rest got a final, I can't see any reason why you wouldn't get the same, but only you can answer that as you know the relationship you have with your bosses.

    So why has everyone accused you of lying? Well boss, they are all in trouble so want to drag others down with them. If one employee is blamed he'll get sacked. If more employees get blamed there's a higher chance they'll just get a warning. We call that diversify the blame so each of us doesn't get blamed as much.

    i just want to keep my job.

    but to be fair its me who wont want to work with them if I get my job back. I have done so much for all 4 of the other people implicated. 2 i got them the job and have solved so many problems for them.
    1 I saved his job twice.
    lost count how many times I have put my neck on the line for them
    and during my meeting I stuck up for them and put in a good word.
    THEY SOLD ME DOWN THE RIVER :(

    I am hurt by what they have done and I will know in never to help any one again.
