They Chaced Me And I Had One Payment Plan Setup Back In 2002
Year Later I Went Away For 18 Months Split From My Ex Moved Back In With My Mum Before Moveing To Oldham i have moved 3 times since oldham my 2nd address active capital contacted me i ignored it again about the debt and its been ignored for ages now and no further contact i moved last year to this new address had one letter from active capital asking for the money at a reduced rate from 3,000 to 1,100 fair enough if i had it i would of paid it just to shut them up then i come accross this site
now active capital have passed this onto Tempus Solutions which i have had no contact from active capital for over 8 months again offering me a big reduction and at the botom please donot ignore or further action will be taken.
the question is
A> can they take further action
B> i have been reading that it should be barred after x amount of years and there just trying it on
C> should i goto citizens advice
D> contact them via phone which i realy hate doing becouse i hate being spoke down to like im a child

If the creditor have not obtained a ccj and you have not acknowledge the debt in writting or by making a part payment in any 6 years period, then the debt would be statute barred now.
Once statute barred, you can inform the creditor you will not pay the debt and they will have to cease any collection activity. Letters here.
The creditor should also not harm your credit file this late after breakdown occured. It is worth going though them to be on the safe side.0 -
sounds like its stat barred and they cant do anything if you havent paid anything or admitted owing it in writing. Anything showing on your credit files?Sealed pot challenger # 10

Follow Vitak's advice and if Lloyds come back with any argument, post again.
Lloyds don't normally offer full & final settlement at 35% so it sounds like they know it's statute barred.0 -
ok thankyou i shall keep posting if i hear anything else from this company0
