washing machine leak, can i claim?

    What actual damage did the leak cause?

    You cant charge the tenants for your plumber ripping up tiles because of his ineptitude.

    At a bare minimum, you should change your plumber

    There was a £400 redecoration bill. The water had gone under the flooring.It sounds rediculous but everyone thought it was under the floor...I suppose thats why you pay for a plumber:o
    Anyway i thnk it will get thrown out on the grounds of time as well. but i will give it a go...lesson learnt

    Doesnt sound like you have learnt that much TBH! As a LL you should be professional and fair in the way deposit deductions are made. "give it a go" doesnt cut it.

    Do you have signed inventories. Do you understand wear and tear / betterment, etc? (check here ... http://www.thedisputeservice.co.uk/resources/files/A-guide-to-deposits-disputes-and-damages.pdf )

    You will also need to be much more specific .. water went under and damaged what exactly? How was it damaged? How was it replaced / repaired? What was the original condition / age?

    One question....why now?

    Why not months ago, howcome you are only now looking into costs?? I don't think it's fair to be passing these costs onto your tenant personally. But fair and legal are two different things.

    Sounds like you have been ripped off and you have just figured this out, so are looking to reclaim some of the rip off costs from the tenants. Should be the plumber.

    Secondly, would this not have been covered under insurance?

    Do you mean redecoration or do you mean repairs to the flooring? Was this not covered on your insurance policy? Again why didn't you charge the tenants at the time? If morally it's too long ago to claim against the plumber it's too long ago to claim against the tenant, why penalise one and not the other? The plumber has scammed you whereas the tenant has acted 'in a tenant like manner' by informing you of the leak!

    Sorry but I agree with the others you are being unfair and unprofessional.
