    you will be OK as long as you keep them out your house and maintain payments

    the council may tell you that your payment agreement is OK but you must pay rundels

    you tell them you have no problem with this as long as the payment can be made by standing order and you will not be charged a fee for making payments

    I'm on here most days as is a few other knowledgeable posters however if you are having further problems and need immediate help i would suggest you post on here

    one quick last one is it safe to park my car out front now??
    and should i black out my make model and registration on my car insurance forms ?

    can you confirm its your car they have put on the notice of seizure ? (sorry but i should have ask this previously)


    you don't really have to send them your insurance or tell them you are self employed because the car is on hp

    the fact your car is on hp is enough to make the notice of seizure unlawful

    personally i would park it outside my home because if the bailiff has the reg (on the notice of seizure) they may use anpr to locate and remove it if you can see it and they try to remove you can go outside (locking the door behind you and recording everything ) and show the bailiff a copy of the hp agreement


    if its not your car on the notice of seizure you tell them you are not the owner of the car levied against your debt bailiffs can do a dvla check to confirm ownership of a car

    if they don't have the reg you send them nothing and because its a public car park you use they will be pushed to work out what car is yours if its in a public car park and not parked directly outside your house

    only if they have a levy on your car(your reg on the notice of seizure) you provide a copy of the hp agreement

  • they haven't got my reg they just wrote ford focus and a scribbled reg number
    which isn't even a number
    so shall i delete every thing about the car and hp from my letter?
    can they just turn up and take my car if they get the registration ?

    Re:

    I understand Council has appointed you to recover my Council Tax Liability arrears for 2012 of £1149.35

    Firstly I would like to make you aware that I am fully aware of my rights and you will not gain entry to my home under any circumstances to levy goods and I know the fees allowed under statute and when these fees can be applied.
    Also Such tools, books, vehicles and other items of equipment as are necessary for use personally in employment, business or vocation”.
    Could you please note that, although I have the use of a motor vehicle, this is however this is not owned by me and is on a hire purchase agreement








    Due to my circumstances I am unable to pay this in one payment. I advocate a payment schedule of 12 months with 12 months payments at £95.78. I understand this may seem a long time but this is a realistic offer that is affordable to me and will allow me to pay future bills issued for Council Tax without them falling into arrears. A greater amount would cause me real and actual hardship.

    I am able to pay the above amount by the end of each month, as an act of good faith I have made a payment to the medway council online payment system of £50 ref xxxxx Please advise how you would like future payments made. My personal preference is payment by Standing Order.

    It should be noted that I am not at any point refusing to pay this debt but only asking for a fair payment period considering my circumstances. And if you are unable to accept my offer I will place the money aside each month until such a time the council take the account back into their management, when I will make payment of the set aside money to the council.

    Please also send an itemised statement of account that clearly shows what charges have been added and what for, you are required in statute to supply this information and I look forward to this within 14 days.

    I am sending the council a copy of this letter and requesting that it be filled with my account for further reference.

    I hope the above meets your approval and I look forward to your timely reply by letter.

    send this to the revenues department of your council and a copy to rundles

    Rundles /bailiff MRxxx has refused my offer of payment by instalments and insists on full payment only

    Bailiff Mr xxxx attended my home on (levy date) and left a notice of seizure of goods and inventory (copy enclosed attached) listing a vehicle unfortunately the registration is illegible however it states the car in question is a ford focus
    I am not the owner or registered keeper of said vehicle and have no knowledge as to who the owner is i therefore request that Medway Council remove the levy and associated fees from my account and provide me with a revised breakdown of my account

    As for your car its very unusual for a bailiff to remove a car without first having a prior levy against it

    the bailiff should establish ownership before removal and the council would have to agree to the removal

    as you say outside your home is a car park so it will be very hard to establish who owns what unless the bailiff can see you using the car

    Just to understand a levy is a charge placed on goods and if you don't pay when stated they remove goods (if entered). So levy comes first.
