Egg PPI - Ombusman no longer dealing with these claims?

Hi,
I have been trying to claim back PPI from my 2002 Egg Credit Card which I was unaware I was paying until clearing out some old emails came across one from Egg stating my payment protection was changing companies! I therefore put in a claim, got it seems the usual four point rejection letter. I then replied stating again why I didnt think this applied to me and again Egg came back and said go away.
I rang up the Ombusman this week to make a claim and was told they are no longer processing Egg claims.
Any ideas what I can do and seem at a bit of a loss now

Do you know if EGG were regulated by FSA or GISC at the time you were sold the policy?
Just wondering, because the FOS are only able to deal with complaints if the business were regulated at the time you take the policy out.
However, did the final rejection letter confirm for you to complain to the FOS, or any other avenue?The one and only "Dizzy Di"

From the MSE guide:
"there's always the option of taking court action against the PPI provider via the small claims system. The complaint is generally on the grounds that it's misrepresented your contract (and therefore made it invalid) if it didn't give you the full facts about the product or ask for all the required information.
This can actually be quicker than using the Ombudsman but will involve costs, eg, £50 for smaller amounts, up to £300ish for larger reclaims - although you will get these back if you win - and there's always the risk you'll have to argue it in court.
If you have good grounds, and understand the legal arguments, then do consider it. There's a good chance it will force the PPI company to settle, but there are no guarantees."
If you don't understand the legal arguments, follow the other advice "find yourself a local lawyer willing to take the case on, or a no-win no-fee legal firm"

2002 sale - so Egg not regulated by the FSA.
I am not certain about GISC. However, Egg was owned by Prudential then. Prudential almost certainly did subscribe to the GISC code so if it wanted Egg to sell its products then egg would have had to as well.
So I think a complaint to FOS would be investigated (although that is not the same as saying it would be upheld).0 -
Hi,
I did get a final reject letter from Egg saying I could take up with the FOS so I assume I was covered. Hoewever when I rang up they put me on hold as they had that day some new news about egg claims and was then told they couldnt take claims any more but to keep an eye out for any future developments. Would be nice to know why they have stopped?
Would it be worth talking to one of the PPI claim companies since the FOS route seems closed to me (which Im a little disappointed in). Obviously I would have to pay a fee but might have more of a chance?

You only get one bite at the cherry, the claims company would get exactly the same response. They will only do exactly what you have done so I really wouldnt waste your time.make the most of it, we are only here for the weekend.

What we don't know is why the OP thinks it was missold or the circumstances of the sale.
If it was a non-advised sale and the policy had to be opted in to (as opposed to opting out) then there is no missale anyway.
Remember, simply ticking the box on "autopilot" is a mispurchase, not a missale and the fault lies with the purchaser not the seller.
If they believe it was missold, the OP should send a complaint to FOS anyway.0 -

When I took out my card I specifically dont remember selecting anything for PPI as didnt need it as card was only meant to be used sparingly. It was only a few weeks ago when a friend put in a claim against egg did I think to check if I had it as didnt think they did it. I assumed I didn't but when I saw the email about the provider changing I realised I must have done. I did some research and found out that PPI was set as an opt out when filling in the online form so its possible that is where it was applied. It was a while ago but Im sure I would have spotted in when filling in the application
I shall send the FOS a complaint form anyway just to see if they reply with an official reason0 -
If you think it was an opt out, then submit the complaint.
You need a decision from the engine driver (Ombudsman) or at least the fireman (adjudicator), not the oily rag (call centre).0 -

I work for the Financial Ombudsman Service and spotted your post. We are still looking at complaints against Egg credit cards, although they are now owned by Barclays, so in some instances the complaint may have to be set up against them. Egg have been regulated since October 1996 and therefore in most cases we can look at complaints going back to that date.
