    Firstly, Em67, perish the fear that you'll be the one who goes to court. On here we don't advise unlawful actions so when we advise people to ignore and most of all not to pay, the information is 101% accurate and legal. Athena's little invoice is wholly unlawful in that it seeks a figure that goes well beyond landowner's losses which means it is a de facto penalty and therefore, unenforceable. So if they try court, they know they will lose and this without you even speaking a word, hence the reason they won't be trying that route.

    If your ticket was affixed to your windscreen, don't even reply - let the time pass, let them BUY your details from the DVLA and start the process from there.

    If they've done this and sent you a postal invoice, in light of their reference to Schedule 4, you only have to make any half-realistic representation. Apologise that you were tired on the day and tell them it won't happen again or the like - BUT DON'T USE THE WORD "APPEAL" as to do so reveals you accede to their authority.

    Await rejection, then screw them by writing to POPLA again aviding the word "appeal", use the reference number which Athena will send you in their rejection letter, and simply tell them that it is an illicit charge as it goes beyond losses, Bye-bye! Won't matter what POPLA say because it is not binding for you but it will have cost Athena £32.

    But what their letter doesn't say is that the notice must contain certain information for them to be able to invoke POFA. I bet it falls short.

    This is why hijacking other people's threads can lead to confusion. When did you commit your parking 'contravention'? The Original Poster's was BEFORE Oct 1st and hence my advice is valid. Yours was AFTER Oct 1st so my advice isn't valid at all and should be ignored.

  • On the strength of reading these many posts I ignored the first written notice and have now received the second, an 'overdue reminder' which doubles the amount that Athena ask for. Can I be assured that they will not be able to do what they threaten, either to initiate further proceedings or to pass this on to a debt collection company? The date of issue was 21/11/12, in a letter which was addressed to me.

    why are you worrying, they cannot do a thing, they give out FAKE parking fines/invoices,a debt collector has zero powers,end of.just ignore and read the stickies, what letters to expect,,,then continue to ignore and they will go away sooner,,quick lesson,,,a PARKING charge notice=fake/con/fiddle/scam,,what to do=ignore, full stop.you have this,,,now a PENALTY charge notice,issued by police/traffic warden/local councuil=genuine=must pay=can appeal,you DO NOT have this,, aint the job a belter then.stop worrying, feet up,chill, glass of wine and read the stickies.

    Be assured - There must be thousands of PE threads on here and I don't think I've ever seen one go beyond the threatening letters, which in my case stopped before the usual chain finished.

    Heard nothing at all since and there is no way they could pursue it now! :)

    As I recently drove out of a Parking Eye infested car park 2 hours and X minutes after entering the 2 hour parking zone I said to Mrs theHibby "I've just saved £80", "how/" she asked, "by not paying the ticket PE will send me I replied". And you can save money the same way by totally ignoring them.

    p.s. if they do bother to write it is the 5th fake parking ticket we will have received from a scammer. And the 5th that will go unpaid.
