Bought Comet Ex Display Washing Machine Today.. NOT WORKING HELP!!

My washing machine broke down so I went to Comet tonight to get a replacement. All the models I liked were going to take over a week to deliver... too long to wait (I am currently building a laundry mountain!)

I saw an ex-display washing machine in store it was described as having a small dent in the back (only cosmetic) and was discounted by £75... As I'd have to wait for over a week for the other model I decided to buy this one instead of waiting.

I got the washing machine home this evening and installed it. The weird thing is, that it was advertised as ex display but when we were maneuvering the machine into its place there was water coming out of the machine, surely this isn't normal? Anyway... After faffing about and getting it all set up, I went to turn it on and NOTHING. It doesn't even power up. I changed the fuse, still nothing. So basically I've just bought a duff machine.

Does anybody know what my rights are regarding this? Can I get them to replace the machine, even though this machine was an ex-display? I mean, can I get them to replace it the same machine/model but new from the manufacturer? Or will I have to get a refund? Can I get them to collect the machine as they sold me a machine not fit for purpose? Any advice at all would be appreciated.

PS (I took out their insurance policy for the machine) Can I refuse a repair on the machine? Especially as this is supposedly a 'new' unused machine, I take it I can refuse to have it repaired and expect a 'new' replacement.

  • Firstly, don't worry about the water in the machine.
    They are usually tested in the factory and there will often be some water left in the pump or some of the pipes. I've had this on machines that have come straight from the manufacturer.

    You have the right to reject the washer and not opt for a repair but you don't have the right to insist on a replacement.
    Comet would be within their rights to offer a full refund.
    Some people will say that you could sue for loss of bargain (sue for the difference in the amount you paid and the cost of buying another machine elsewhere but in reality this will be very time consuming and you are not guaranteed to win).

    There is nothing to stop you asking for a repair (as this may be the quickest option of getting a working machine), and if the repair fails or takes too long, you still have the right to reject it and ask for a refund.

    As to collection.
    Yes, you can ask Comet to collect the washer and they are liable for all the costs involved.

    Given past stories of Comet, they will almost certainly try to fob you off. If you want to reject the machine and get a full refund, stand your ground and insist.
  • Have you confirmed that there is power getting to the socket or spur which the washing machine is connected to?
    If your old machine was faulty, it may have blown a fuse or tripped a breaker in your consumer unit.

    Loss of bargain would not come into this, (I am a firm believer in loss of bargain that not many people realise they have) for 2 reasons

    1. loss of bargain only covers broken contracts where one party fails to honour the contract in the first place, i.e they fail to deliver the goods. In this case the contract was completed, SOGA now takes over.

    2 The machine was sold as cosmetic damage and reduced accordingly, so like for like is not possible. (1 makes that a mute point anyway)

    If you want to keep the bargain, get the manufacture out to fix it.

    Hi thanks for your replies. Just to update you, I called Comet today to explain what had happened. They have offered to replace the faulty machine with a new one (being delivered Saturday) and take the faulty one away. I'm more than pleased with the outcome.
