  • the way i see it, is to attend the court hearing, you have to make it feasable to defend it or you lose by default if you dont turn up (by you i mean those who are in same situ as you OH).

    turn up, ask the court to find in your favour as the delay was and back payment was due to HB (take along your decision notice) it will state the date of claim back payment and also the decision date.

    and argue you point and case.

    What you should have done was placed a written request for payment on account, which the council should give unless there is no realistic prospect of the claimant being offered benefits.

    How was he to know that though? He'd placed a claim for HB and was assuming it was being dealt with as quickly as was possible surely?

    And from what I hear the ones that aren't are doing even worse than the ones that are! Which is not surprising when you don't have enough people to do the work required.

    Your relative should have attended the court hearing and explained he had a claim in, then he should not have got a court order made. If he didn't attend and explain to the Court what the situation was then he will have had an order made. The departments should be communicating though but as the claimant and tenant you can't just sit back and expect everyone to sort it all out for you.

    If its just been issued and not yet gone to court hearing then he will have to attend the hearing and explain that he was waiting for HB and should not have had the claim issued, and request he doesn't pay any costs. This may or may not work.

  • Not to worry folks - HB will not be processed by LA's with the introduction of Universal credit......

    It will all be processed online and assessed / handled by a call centre in Warrington :eek:
